Please be advised that Verizon Wireless'Application is governed by Section 6409(a)of the Middle Class Tax Relief and Job Creation Act of 2012 (the "Spectrum Act"), codified at 47 U.S.C. § 1455(a), which provides, in relevant part,that a: State or local government may not deny,and shall approve,any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station. (Emphasis added). An"eligible facilities request"is defined as"any request for modification of an existing wireless tower or base station that involves—(A)collocation of new transmission equipment;(B)removal of transmission equipment; or (C) replacement of transmission equipment." See 47 U.S.C. § 1455(a)(2)(A)-(C)(emphasis added). The Federal Communications Commission (the "FCC") Report and Order No. 14-153, 29 FCC Rcd. 12865, adopted on October 17, 2014 (the "FCC Order"), codified at 47 C.F.R. § 1.6100, provides clarification of the Spectrum Act, and sets forth a 60-day time period for review and approval of applications covered under the same. Verizon Wireless respectfully submits that the Spectrum Act and the FCC Order directly apply to this Application, and require the Town to approve the same as proposed, without the need for a protracted zoning process or public hearing(s). Verizon Wireless currently operates the Communication Facility at the existing monopole located on the Property, which constitutes an existing "wireless tower" within the meaning of the Spectrum Act and FCC Order. As depicted on the construction drawings,and discussed above,Verizon Wireless proposes to modify its Communication Facility by removing and replacing antennas and equipment on the monopole and by removing, replacing and adding equipment on the equipment platform at the base of the wireless tower. As such, Verizon Wireless' Application involves requests for removal, replacement, and collocation'of transmission equipment at the Communication Facility. Further, Verizon Wireless' proposed modifications to the Communication Facility would not substantially change2 the dimensions thereof. The top height of the proposed new antennas would be consistent with the top height of the existing antennas, and no portion of the modified Communication Facility will protrude from the edge of the wireless tower by more than twenty feet. See FCC Order§ 188;see also FCC Report and Order No.20-153,2020 WL 6501650(FCC October 27,2020). modifications to the Communication Facility would not require any excavation or deployment beyond the area of the existing equipment compound. Finally, the proposed modifications would not affect any concealment elements of the existing Communication Facility.'
