The existing dwelling, which was constructed prior to 1957(see Preexisting Certificate of Occupancy No. Z- 22899)is to be raised, in-place,to a FEMA-compliant elevation, and modified with a second-floor expansion over the existing 1-story portion of the dwelling and covered porch located 6.4 feet from the southerly lot line; and an extension of the same covered porch, all without additional encroachment on the existing side yard setback. By thus improving the dwelling's flood protection and maintaining the side yard setback that has been in place for more than 65 years,the project will avoid causing an undesirable change to the character of the surrounding neighborhood or a detriment to nearby properties. Specifically, in addition to the subject property, there are 10 other waterfront properties located along Inlet Lane and Bay Road, 7 of which are separated from Gardiners Bay by the tidal waters of Gull Pond Inlet. And due to the presence of Gull Pond Inlet, all but one of those 7 parcels have preexisting nonconforming undersized lot areas. (The subject property has a total lot area of 22,150 sf and a buildable land area of 16,925 square feet). Like the subject property, at least 4 of the 10 other waterfront properties are characterized by dwellings with nonconforming minimum side yard setbacks, including all 3 properties located along Inlet Lane to the north, two of which were established pursuant to variance relief. For example, in 1989, the property located two to the north was granted relief to construct a deck addition that reduced a previously conforming side yard setback by 12 feet to 3.6 feet from the southerly property line (Case No. 3833); and in 1961, the property located three to the north was granted relief to construct a dwelling addition that reduced a preexisting nonconforming side yard setback by 2 additional feet to 8 feet from the southerly property line (Case No. 403). In the latter case, the Board based its relief in large part on the observation that the wetlands on the property effectively constrained the property's development to the most southerly side of the property. And here, similarly, because the wetlands encroach farther landward on the northerly side of the property, the wetlands setback remains maximized by raising the existing dwelling in-place, on the most southerly side of the property, and adding onto the southern portion of the house. By doing so, the historically existing site condition relative to the surrounding neighborhood and nearby properties remains substantially unchanged. 2) The full benefits sought by the applicant through the proposed renovations cannot be achieved without variance relief due to the dwelling's preexisting nonconforming location in relation to the southerly lot line, specifically its 6.4-foot setback where a 15-foot setback is required. These proposed additions and alterations would create an additional bedroom, bathroom, and study, while providing a minimal extension of the covered porch and roof deck to replace the one being removed by the 2nd floor addition. (Additional proposals include the addition of a front entry porch; replacement of the outdoor shower on the north side of the house; and relocation of the existing shed to a zoning-compliant location in the front yard, none of which require variance relief). It should be noted that without these additions, there would be no need to replace and upgrade the existing conventional septic system with a low-nitrogen, I/A sanitary system, as proposed(see#4 below). 3) The requested variance is mathematically substantial, representing 8.6 feet or 57 percent relief from the required 15-foot minimum side yard setback. But the relief is not substantial in fact because the additions and alterations will not diminish the preexisting nonconforming setback that was established more than 65 years ago; and, as described above, at least 4 of the other 10 waterfront properties located along Inlet Lane and Bay Road are similarly characterized by dwellings with nonconforming side yard setbacks, ranging from 3.6 to 11 feet, including two with side yard setbacks established pursuant to variance relief. 4) The proposed project will not have an adverse impact on the physical or environmental conditions on the site or surrounding neighborhood. Rather, it will have a net beneficial impact through mitigation measures designed to reduce potential flood damage; protect and improve water quality; and protect and restore the quality and function of the adjacent tidal wetland ecosystem, as described below. a. The dwelling's exposure to potential flood and erosion damage will be substantially reduced by raising it to a FEMA-compliant elevation. b. The dwelling's minimum wetland setback will not be reduced, as the footprint expansions are located on the west(front) side and southeast/southwest corners of the house. c. Lot coverage will increase by only 228 square feet to 9.57 percent, and a stormwater drainage system is proposed to capture and recharge potential runoff from both the roofed dwelling and other impermeable surfaces, as well as the pervious gravel driveway. d. The existing conventional septic system will be removed and replaced with a low-nitrogen, innovative/alternative sanitary system (UA OWTS) located more than 160 feet from wetlands (and thus well outside Chapter 275 jurisdiction), which unlike conventional septic systems is designed to significantly reduce nitrogen loading into the groundwater table. `Rdbert E.
