The proposed reconstruction of the 172 sf, formerly roofed-over deck attached to the waterside of e'. lling requires relief pursuant to Section 280-116(A)(1) because it is located approximately 1 feet om the top of bluff, where a 100-foot setback is required. Granting this relief would not ce an undesirable change in the character of either of the two neighborhoods surrounding the property, neither that to the west, which is represented by dwellings located at high elevations landward of a bluff, nor that to the east, which is represented by properties without a bluff, where dwellings are located much closer to sea level and Long Island Sound. The applicants' property is uniquely located at the divide between these two communities because it is situated at the easterly terminus of both the geologic and Town-defined bluff to the west. Due to its partial bluff and high elevation, however, the property is distinctly part of the bluff-front neighborhood to the west, which is characterized by numerous other properties which, like the applicants, are improved with dwellings situated well less than 100 feet from the top of bluff. And although most of these dwellings were, like the applicants' (see Pre-C/O No. Z-12348), constructed long prior to the Town's adopt* , of bluff setb�l�s two nearby properties have benefited from bluff setback variance relief. There is also no change in conditions that would directly or adversely affect the neighbo ng properties, especially since 1) the dwelling and deck conform to all required side yard set s; 2) the most westerly portion of the existing dwelling separates the deck from the westerly nei bor's view; and 3) the neighboring dwellings to the east are located at much lower elevations, substantial distances away, and much farther seaward (neighbor to northeast) or on the opposite 'dLoff Huntington Boulevard (neighbors to east/southeast). The applicants are seeking to replace an aging waterside deck, whose historically existing roof was recently removed due to severe water damage and rot that was discovered during repairs of leaks and water damage to the main roof. The deck cannot be replacedwith t the benefit of relief from the required 100-foot bluff setback because it is located approximate) 41 feet from the top of the bluff to the northwest, on the east side of the habitable dwelling footpn t that is located approximately 29 feet from the top of bluff. 3. The required bluff setback relief f 59 fee s mathematically substantial, but it is not substantial in fact because the new deck would eco tructed in the same footprint as the historically existing deck, with a pergola above it instea of the previously existing roof. Thus, there is no change or reduction proposed to the preexisting bluff setback. 4. Reconstructing the existing deck in the same footprint will not cause any adverse impacts on the physical and environmental conditions of the subject property. The toe of the bluff, which is stable and well vegetated, is located almost 300 feet from the surface waters of Long Island Sound, and the dwelling and deck are located more than 300 feet from the Sound. The dwelling and deck are also located well more than 100 feet north of Autumn Lake and the associated freshwater wetlands that bound the property to the south. To mitigate any potential impacts of the proposed construction activities, however, a stormwater drainage system is proposed to capture and recharge runoff, a 5 to 10 foot wide, approximately 1,035 sf non-turf buffer is proposed along the top of bluff and bank; and a project-limiting fence will be installed to contain site disturbance and limit runoff during construction. And though related not to the deck replacement but to interior dwelling renovations not requiring variance relief, the existing conventional septic system is proposed to be removed and replpced with a low-nitrogen, I/A sanitary system consisting of an I/A OWTS located at least 65 feeYfrom the top of bluff. Unlike conventional systems that are not designed or equipped to treat nu. ents such as nitrogen, I/A systems are designed to significantly reduce nitrogen loading into te groundwater and ultimately surface waters. And in connection with other exterior site renovations not requiring variance relief, including the construction of an accessory garage and drive ay, the garage is proposed outside wetlands jurisdiction associated with Autumn Lake; e ne driveway is to consist of pervious gravel; and the exisrting 2,120 sf asphalt driveway is to e r moved, thus eliminating all developed and impervious surfaces from within 100 feet of Autu driveway 5. McKEAND & SHANNON GOLDMAN 100 SALT MARSH LANE PECONIC,NY SCTM#1000-68-3-11.1 Policies 4, 5, and 6 Reconstructing the existing deck will not cause any adverse impacts on the adjacent bluff, beach, and tidal surface waters on the north side of the property or to the lake and freshwater wetlands on the south side of the property. The toe of the bluff, which is stable and well vegetated, is located almost 300 feet from the surface waters of Long Island Sound, and the dwelling and deck to be reconstructed are located more than 300 feet from the Sound. The deck to be replaced is situated farther from the top of bluff than the existing habitable dwelling footprint to remain, and the deck is being replaced in the same footprint, with no expansion in size or reduction to the existing bluff setback. The dwelling and deck are also located well more than 100 feet north of Autumn Lake and the associated freshwater wetlands that bound the property to the south. To mitigate any potential impacts of the proposed construction activities, however, a stormwater drainage system is proposed to capture and recharge runoff; a 5 to 10 foot wide, approximately 1,035 sf non-turf buffer is proposed along the top of bluff and bank; and a project-limiting fence will be installed to contain site disturbance and limit runoff during construction. And though related not to the deck replacement but to interior dwelling renovations not requiring variance relief, the existing conventional septic system is proposed to be removed and replaced with a low-nitrogen, UA sanitary system consisting of an UA OWTS located at least 65 feet from the top of bluff. Unlike conventional systems that are not designed or equipped to treat nutrients such as nitrogen, I/A systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. And in connection with other exterior site renovations not requiring variance relief, including the construction of an accessory garage and driveway, the garage is proposed outside wetlands jurisdiction associated with Autumn Lake; the new driveway is to consist of pervious gravel; and the existing 2,120 sf asphalt driveway is to be removed, thus eliminating all developed and impervious surfaces from within 100 feet of Autumn Lake.
