EILEEN KASSCHAU#7681-Request for Variances from Article XXII, Section 280-116A(1)and Building Inspector's May 6, 2022, Amended June 22,2022 Notice of Disapproval based on an application for a permit to legalize"as built" accessory decks and shed located seaward of the top of the bluff, and to construct additions and alterations to an existing single family dwelling; 1)dwelling located less than the code required 100 feet from the top of the bluff; 2)three(3)"as built" decks located less than the code required 100 feet landward of the top of the bluff, 3) "as built"frame shed located less than the code required 100 feet landward of the top of the bluff; located at: 5800 Vanston Road, (Adj. to Great Peconic Bay)Cutchogue,NY. SCTM No. 1000-118-1-1.2. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the policy standards and therefore is INCONSISTENT with the LWRP. This determination is based upon the following: Note that the Southold Town Trustees issued a Wetlands Permit 4958 in 1999. The existing shed and deck do not conform to this permit specification. The permit specifies a 6' x 20' deck and the survey shows a 10.5 x 37.0'.. The lower wood deck extension is unpermitted. The shed was permitted as 8' x 10' and the existing shed is 8.1' x 16'. Both structures are non-compliant with the Wetlands Permit. Policy 1. Foster a pattern of development in the Town of Sozrthold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The(as-built) structures are not supported by this policy as it does not enhance community character and sets precedent contrary to the board's procedures and authority. Further,these as-built structures set a precedent in areas where structure should be avoided and minimized. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. 1. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures that functionally require a location on the coast or in coastal waters. The single-family residence and deck, and shed do not require a location on the coast. According to FEMA,the parcel is susceptible to storm damage. All unpermitted structures seaward of the top-of bluff are located within a VE(Velocity Hazard)EL 12' flood zone. The structures within these areas are subject to repetitive loss from storm surges and flooding and should be avoided and/or minimized.
