FURTHER OUT EAST-C/O TOM DOWLING#7655 -Request for Variances from Article XXIII, Section 280-124; and the Building Inspector's December 20, 2021, Amended January 3,2022 Notice of Disapproval based on an application for a permit to demolish and reconstruct an existing single family dwelling; at; 1) less than the code required minimum front yard setback of 35 feet; 2) less than the code required minimum rear yard setback of 35 feet; 3)more than the code permitted maximum lot coverage of 20%; The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action to construct a 381.25 screened porch along the easterly side of dwelling is INCONSISTENT with the Policy Standard 4 and therefore is INCONSISTENT with the LWRP. This determination is based upon the following: Note that the Southold Town Trustees issued a Wetlands Permit 9882 and the Town Board issued a Coastal Erosion Hazard Area Permit(9882C) on September 21,2021. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. 1. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. The single-family residence does not require a location on the coast. The proposed screen porch to be located 11.5' to the bulkhead is not supported by this policy. According to the Suffolk County Hazard Mitigation Tool,the parcel is susceptible to storm damage. This area suffered damage from Tropical Storm Sandy. Portions of the structures are located within the CERA. The proposed 69.7 percent lot coverage on the parcel is contrary to preventing loss to structure in hazardous areas. The structures within these areas are subject to repetitive loss from storm surges and flooding and should be avoided and/or minimized. Pursuant to Chapter 268,the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1.
