The pergola was designed to blend with the architecture of the house,creating a shaded dinning area. This house is located at the end of Fairway Drive.Fairway drive is paved to just beyond the driveway,creating a situation where the front property line is not used by vechicles.Fairway Drive dead ends into the wetlands associated with the head West Creek,and there is very little pedestrian traffic.The location of the pergola in the side yard has Tittle inpact on the character of the neighborhood. 2,The benefit sought by the applicant CANNOT be achieved by some method feasible for-the applicant to pursue; other than an area variance,because: The orientation of the house varies slightly from the immediate neighbors due to the relationship with the golf course and the paper road. The proposed pergola is located central to indoor and outdoor activities. There is no alternative space where the homeowner may locate the pergola which offers the same connection to the house and pool. 3.The amount of relief requested is not substantial because: The proposed Pergola is 280 sq.ft.it has 4 columns.it is an open structure to provide shade for outdoor dinning. The lot coverage is.65%,which is not substantial.The total lot coverage existing is 10.3%.Including the pergola the lot coverage is 10.95%,well under maximum allowable lot coverage. 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The proposed pergola is small in nature and it allows water to shed.There is no adverse effect this structure. 5.Has the alleged difficulty been self-created? {x}Yes,or ( }No Why: Yes,this is a self created difficulty. The existing conditions do not allow for a shade structure in a location which complies with zoning regulations and allows the owners to use their yard to its best advantage. PROPERTY FACTS/DESCRIPTION: Applicants' property is located on the west side of Fairway Drive, in Cutchogue, referred to at Lot 16 on the Map of Fairway-Farms. The property is a 41,774 sq. ft. parcel .improved with .a two-story, single-family dwelling and attached one-story garage, as shown on the survey prepared.June 29, 2002 by Barrett, Bonacci.&VanWeele, P.S. BASIS OF APPLICATION: The.basis of this application is the Building Department's September 19, 2002 Notice of Disapproval concerning applicant's request for a permit to locate an accessory in-ground swimming pool partly in a side yard rather than entirely in the rear yard as required by Zoning Code Section 100-30A.4. FINDINGS OF FACT The Zoning.Board of Appeals held a public hearing on this application on January 16, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant proposes to locate an 18' x 36' in-ground swimming pool, on an angle at approximately 10 feet from the rear northwest corner of the house with attached garage. The setbacks from the pool at its closest points are proposed at 59+- feet from the rear line and 20+-feet from the side lot line. REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a well-established sub- division with relatively large homes situated on about an acre of land. This property is a 41,774 square foot parcel, which allows the proposed setbacks of the accessory structure to meet or exceed the code-required setbacks from the closest side and rear property lines. 2. The benefit sought by the applicant cannot be achieved by some other method feasible to pursue than a variance. The pool visually gives the appearance of being 100% at the rear of the house. Architecturally and visually, the swimming pool would be behind the house. 3: The variance.granted herein is not substantial. Only a small portion of the-swimming pool will be located in the side yard. 4: The alleged difficulty has been self-created as the applicant was aware of the architectural, constraints of the property when it was purchased. ..5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on_.the physical or environmental conditions- in the neighborhood. Without a variance, the pool would not be able to be placed in this reasonable location. .6.
