The terrace constuction that is proposed would not be visible from any neighboring properties. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: steps are necessary for the terrace construction and the encroachment into the 100-foot bluff setback cannot be avoided due to the existing -- construction. A partial side yard location for the garage is the only option given that rear yard -locations .are all within the 100-foot bluff setback and a total front yard location would be out of character for the neighborhood. 3.The amount of relief requested is not substantial because: while the steps will be added to the existing terrace, their encroachment into the 100-foot bluff setback at 75' 4" is relatively minor in light of the fact that an existing pool and pool house are located much closer to the top of the bluff. The garage will be located partially within a side yard but still well away from the building envelope of the nearest adjoining property. 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: except for the minor encroachment of the terrace steps into the 100-foot bluff setback, construction that will have a low impact, the new construction will be outside of that setback. Moreover, the applicant is undertaking a project for i¢hich it has applied to the rdlevant governmental authorities to inhibit further erosion of the bluff. 5.Has the alleged difficulty been self-created? { } Yes,or tX}No Why: The owner is applying for all required permits before undertaking construction and is attempting to conform to all Code requirements to the extent feasible. The Existing Garage is a single story structure adjacent to the main 2-story house to the North. Number of Floors and Changes WITH Alterations: The Terrace Roof will be elongated and will remain a one floor structure. The New Garage will be a new two story freestanding structure. IV. Calculations of building areas and lot coverage (from surveyor): Existing square footage of buildings on your property: 4,601 sf Proposed increase of building coverage: 1,846 sf Square footage of your lot: 4.00±Acres (174,240±s) Percentage of coverage of your lot by building area: 3.7% V. Purpose of New Construction: The Existing Terrace and Terrace Roof currently consist of multiple sections, and multiple materials. Our goal is to create a Terrace Roof that fits seamlessly into the look and feel of the Existing House, and sits within the existing footprint. The New Garage will allow for more car storage as well as long term storage above. Once the New Garage is built, the old Garage will be converted into a Family Room. VI. Please describe the land contours(flat,slope %,heavily wooded,marsh area,etc.) on you land and how it relates to the difficulty in meeting the code requirement(s): Most of the lot is relativelyflat lat with about a 6%slope from the Existing House to the beach where there exists a bluff with a slope of 85 %. The Existing House sits adjacent to this bluff and the rocky beach of the Block Island Sound. The Existing House, and Existing Terrace sit beyond the associated bluff setback line. This would make any construction to the East Facade non permissive, even within the existing footprint. Building the Garage to code would require a more disruptive intervention to the natural landscape including additional excavation and the removal of old growth trees. The proposed location aims to conserve more of the existing landscape. April 15, 2005 FISHERS ISLAND DEVELOPMENT CORPORATION Restrictive Covenants Relating to Development and Annual Assessment Set forth below are the operative provisions of the restrictive covenants imposed by FIDCO and its predecessors, Fishers Island Corporation and Fishers Island Estates, Inc.
