SAND LENNOX, LLC #7619 -Request for a Variance from Article XXII, Section 280-116A(1) and Building Inspector's November 19, 2021 Notice of Disapproval based on an application for a permit to demolish an existing dwelling and to construct a new single family dwelling at; 1) located less than the code required 100 feet from the top of the bluff; located at 1450 Salt Marsh Lane, (Adj. to Long Island Sound) Peconic,NY. SCTM No. 1000-68-3-1. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposal is recommended as CONSISTENT with the LWRP. This recommendation is based upon: 1. There is a need to remove the structure from the area to avoid collapse and debris from impacting the bluff and ecosystem. 2. The existing structure is partially located within the CERA and the new,proposed structure will not be located within the CERA. The size of the parcel restricts the ability to relocate the new,proposed structure further from the top of bluff. 3. The 50' wide non-disturbance buffer proposed supports Policies 4 and 6. The bluff erosion in this area is severe and is expected to continue without stabilization measures. Clarify why the proposed well and water line is located within this area. The project description reduces the buffer to 30' wide and does not match the survey. 4. The removal of trees on the parcel should be minimized. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
