The proposed action hasbeen reviewed to Chapter 268,.Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
.records available to me,the proposed action is EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions.M1NOR ACTIONS item"F"which states:

1..An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby
properties if.granted,"because:
The location of the proposed addition will replace an existing garden shed/garage which is in disrepair.
Located along the property where the neighboring garage is also non-conforming. This addition will not change the character of the
neighborhood,the property is located on a private road,used by 2 homes,and is generally not seen by any of the neighboring
properties,with the exception of the next door neighbor to the west.The addition has been designed to fit with the existing architectural style
of the cottage.
2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,
other than an area variance,because:
The existing cottage is nonconforming along the west property line. The proposed addition is located to minimize the need for
reconstruction of the home,and maximize the distance to the shoreline.The configuration allows the house to maintain the existing window
locations on most of the south elevation.
3.The amount of relief requested is not substantial because:
The proposed addition is aligned with the existing house. We will be removing an existing non conforming accessory shed to replace it with
the proposed 2 car garage with second floor storage and additional storage space.
The existing.cottage is 1160 sq.ft.,including the other structures on the site the lot coverage is 7.1%,under the allowable 20%.
the proposed addition at 860 sq.ft.footprint will allow for the 2 car garage and needed storage space above the garage,there will be no plumbing
in the proposed garage.The proposed lot coverage at 9.3%will still be below the allowable lot coverage.
4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the
neighborhood or district because:
The proposed addition is designed to respect the shoreline,by situating the new construction at the rear of the house
we minimize the environmental disturbance and minimize the impact the new construction will have on the site.
The location also allows the owners to reuse the existing driveway.

the site has a gentle grade change from 20 ft elevation at the road to 12 ft elevation at the north side,from there it drops to the bulwark,
top of wall elevation is approx.2.The land is typical of a suburban lot with some lawn several large trees,with jockey creek
in the front yard. Trying to minimize environmental impact we would like to locate the garage in a place that relates to the house with
minimal disturbance to the house and waterfront.

DATE OF PUBLIC HEARING: May 3, 2001
FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: Applicant's property consists of 21,594 sq. ft. in area with
100 ft. frontage along the north side of a 15' private road extending off the west side of Oaklawn
Avenue, Southold. This parcel has a frontage of 107.89 feet along Jockey Creek and is improved
with a one-story frame house and accessory garage. The dwelling is shown with an existing,
nonconforming setback of 59 feet from the stone wall at its closest point.
BASIS OF APPLICATION: Building Inspector's March 5, 2001 Notice of Disapproval under Article
XXIV, Section 100-2446, which states that the deck addition in building permit application dated
January 10, 2001 is required to be set back not less than 75 feet from the bulkhead.
AREA VARIANCE RELIEF REQUESTED: Applicant is requesting a deck addition with a setback
of 49+- feet from the outside edge of the stone bulkhead as shown on the survey prepared
November 29, 2000 by Peconic Surveyors, L.S. The dimensions are 10x16 ft. for the deck
addition.
REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and
personal inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The proposed 10 ft. by 16 ft. deck addition
would be located on the waterfront, Jockey Creek, north side of the property landward of the 10 ft.
elevation contour in an area that is not subject to environmental stress. The existing setback of the

at a distance from the stone bulkhead similar to others in the neighborhood.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue other than an area variance because the proposed location of the deck addition
is the most practical and is readily accessible from the dwelling. Although no variance would be
required if the deck were located on the east side of the dwelling, that location is impractical
because of the internal layout of the dwelling.
3. The area variance is not substantial and represents a 10 ft. increase in the existing
nonconforming setback of the dwelling.
