The subject property ("Site") is located at 154 King Street, Orient NY 11957. The Site is an irregular-shaped, non- conforming lot located in a R-40 zoning district within the Orient Historic District. This application respectfully requests a waiver from Article XXIII, Section 280-124 to allow for: the addition of 154 square feet of building area to the single-family residence. The proposed plan also includes the reframing of the garage roof without any additional building area or change of use. The relief requested would allow for Ms. Becker, 76 years old, to relocate her home office/study to the first floor in the event that she can no longer safely access the second floor. Subject Site & Surrounding Area ?'KING The subject property is mapped within an R-40 zoning district 4 12 and is a legal, irregular-shaped, non-conforming lot with a total ' lot area of approximately 0.32 acres, or 14,089 square feet. According to the latest survey dated April 28, 2021 and the Deed, the access/egress to the subject property is from King Street via a right-of-way easement. The R-40 Low Density (1 acre) designation and the Orient Village Historic District reflects the existing neighborhood character. The subject property is improved with a single-family house with an enclosed breezeway attached to a garage. A small shed also occupies • the property. In total, the lot coverage is 2,004 square feet, or 14.2% of the lot area. r r The proposed plan increases the lot coverage by 154 square feet to 2,158 square feet, or 15.3% of the lot area. Appendix A contains the ZBA application forms and relevant property documentation. Appendix B provides surveys, maps, architectural drawings and photos of the subject property. 154 King Street, Orient NY 11957 2 Unique Site Conditions The subject site is unique in the neighborhood with its non-conforming lot area (less than 1 acre at approx. 0.32 acres), its unusual L-shaped site, minimum yard setbacks in certain locations, and its interior lot accessed via an easement from King Street. All of these site conditions are inherent in the Site, act as a constraint towards the efficient functionality of the Site, and are not self-created by the applicant. Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the variance requested. If the variance is granted, there would be no negative effect nor impact on altering of the neighborhood character and would not impair appropriate use or development of adjacent properties. More specifically, the history of uses of the area and at the subject premises demonstrate that the proposed variance is consistent with and will not alter the essential character of the neighborhood. The existing character of the area reflects the goals of the R-40 zoning district and the Village of Orient Historic District. 154 King Street, Orient NY 11957 4 2. Whether the benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue, other than an area variance. The requested variance is the only option that provides the opportunity to provide for a small enlargement at the first floor of the single family home in anticipation of aging in place by the applicant in the event that access to the second floor is not possible. 3. Whether the requested variance is substantial. The requested variance is minimal and appropriate, as it represents a single waiver request of Article XXIII, Section 280-124. The proposed plan is limited to a small enlargement of the first floor by 154 square feet. 4. Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The proposed variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood. More specifically, the proposed plan will not cause any undue burden to neighbors either by introducing an unattractive element in the landscape or obstructing views. 5. Whether the alleged difficulty was self-created, which consideration shall be relevant to the decision of the Board of Appeals, but shall not necessarily preclude the granting of a variance.
