JEANNE AND JOSE CASTANO 47724 - Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's August 11, 2022,Notice of Disapproval based on an application for a permit to demolish (as per Town Code definition) and reconstruct a single family dwelling at; 1) located less than the code required minimum rear yard setback of 35 feet; located at: 1700 Grathwohl Road,New Suffolk,NY. SCTM No. 1000-117- 4-3. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposal is recommended as EXEMPT from LWRP review pursuant to: § 268-3. Definitions.MINOR ACTIONS item "F"which states: F. Granting of individual setback, lot line and lot area variances, except in relation to a regulated natural feature or a bulkhead or other shoreline defense structure or any activity within the CEHA. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
