ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of the meeting is usually available to watch live during the meeting. Minutes with adopted resolutions are available 1-2 days after the meeting. Due to the expiration of the New York State Governor’s Executive Orders regarding the COVID-19 pandemic in-person access to the Public will now be permitted. The meeting will still be accessible via Zoom and streamed live on the Town’s website. The proposed Local Law entitled, “A Local Law in relation to Amendments to Chapter 280, Zoning, in connection with the Affordable Housing District” reads as follows: LOCAL LAW NO. 2023 A Local Law entitled, “A Local Law in relation to Amendments to Chapter 280, Zoning, in connection with the Affordable Housing District”. A. Notwithstanding the bulk schedule set forth in Subsection A of this section, there shall be no more than 24 dwelling units on any one site. C. Authority to amend requirements and specifications. (1) The Planning Board shall have the authority to reduce or amend yard setback requirements, lot dimension requirements, parking requirements, and highway specifications. In making this decision, the Planning Board shall take into consideration the benefit to the applicant, as weighed against the detriment to the health, safety and welfare of the neighborhood or community. In making such determination, the Planning Board shall also consider: (a) Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the amendments; (b) Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the sought variance; (c) Whether the variance is substantial; (d) Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district; and (e) Whether the alleged difficulty was self-created, which shall be relevant to the decision but shall not necessarily preclude the proposed amendment or variance. (2) This provision supersedes and amends New York State Town Law §§ 267, 267-a, 267-b and 267-c insofar as these sections give such authority to the Zoning Board of Appeals. Any amendment to highway specifications shall meet with the approval of the Highway Superintendent. III. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. The purpose of this acquisition is for open space, passive recreational purposes and wetland protection. The Town’s purchase of the conservation easement is contingent on the simultaneous delivery of a fee title deed to the 15.6± acre property to the Seller, The Henry L. Ferguson Museum as Contract Vendee, by the current owner, Fishers Island Development Corporation (FIDCO). The contract between FIDCO and The Henry L. Ferguson Museum is subject to a fund-raising contingency. The Henry L. Ferguson Museum has agreed to provide public access to the property in the form of accessible recreational trails which connect with, or link to, existing trails within the Ferguson Museum trail system and/or the Fishers Island Recreational Path. The Land Preservation Coordinator has reviewed the acquisition in accordance with Chapter 117 (Transfer of Development Rights) of the Code of the Town of Southold, Section 117-7. The address is 10475 Oregon Road, Cutchogue, New York. The property is situated on the northerly side of Oregon Road approximately 550 feet easterly from the intersection of Duck Pond Road and Oregon Road. The property is located within a split zone with a majority of the total acreage in the Agricultural-Conservation (A-C) Zoning District and approximately 2.55± acres situated on the northerly side of the parcel being in the Resort Residential (RR) Zoning District; and WHEREAS, the proposed acquisition is for a development rights easement on part of the property, consisting of approximately 25.7±acres (subject to survey) of the 28.7± acre parcel. The 3± acre Reserve Area will remain linked to, and prohibited from being subdivided from, the area subject to the easement. The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land Preservation Committee and the property owner; and WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase price is $80,000 (eighty thousand dollars) per buildable acre, estimated at $2,056,000.00 (two million fifty-six thousand dollars) for the 25.7± acre easement.
