A meeting of the Southold Town Conservation Advisory Council was held Wed.,
December 7, 2022 in the Town Hall Conference Room and via Zoom.

CALL TO ORDER
John Stein called the meeting to order at 4:30PM.
REPORTS
Shannon Wright attended the Board of Trustees meeting held on November 16, 2022 and
reported the meeting was business as usual.
CHAIRMAN'S REPORT
John Stein recently attended a ZBA meeting.and noted that Chairperson Leslie Weisman
was very diligent to meets and bounds on the,site plans and'strict with setbacks,
consistent with the CAC.

TRUSTEE LIAISON REPORT
Carol Brown requested a meeting with the Board of Trustees to discuss non-compliance
disclosures as part of the application process. Trustee Gillooly suggested she e-mail the
Board of Trustees and Elizabeth Cantrell to request an appointment at their next work
session.
CLIMATE SMART COMMUNITIES
Carol Brown will coordinate an informal meeting with some of the CAC members to .
discuss a funding opportunity opening up in 2023 that could be used for CSC.
APPROVAL OF MINUTES
Moved by Carol Brown, seconded by Shannon Wright, to Approve the Minutes of
November 10, 2022.
RECOMMENDATIONS WETLAND PERMIT & COASTAL EROSION PERMIT .
APPLICATIONS
Moved by John Stein, seconded by Carol Brown, it was
RESOLVED to NOT SUPPORT the application of TG3 HOLDINGS LLC c/o TIMOTHY
QUINN for the demolition of the existing 20'X 40' vinyl pool and replace with 20'X 40'
gunite pool, replace existing deck with paver patio at grade.
Located: 1 Mulford Court, Orient. SCTM#14-2-1.6

The CAC does Not Support the application because the application does not include
information regarding the legality of the existing pool. The pool should be replaced in a
location parallel to the dwelling.

RESOLVED to SUPPORT the application of ROBERT G. SCHNOOR, GREGORY A.
SCHNOOR, AND CHRSTINE E. VAN DYKE for a legally pre-existing bluff stairway ,
consisting of a 7.8'X 8' top landing,-3'X 15' steps, 6.1'X 8.2' middle landing (with 2
benches) and 3'X 14' steps to beach.

Moved by John Stein, seconded by John Chandler, it was
RESOLVED to NOT SUPPORT the application of KARAN AHOOJA to remove existing
wood retaining wall 21 If., clear phragmite landward of retaining wall, 600 sf., fill cavity
behind bulkhead with clean fill, 22 cy. Install 37 If of new wood retaining wall utilizing
pressure treated lumber, install two (2) wood returns running 20' up the slope from the
new wood bulkhead and,constructed with 2-3"X 12' boards set vertically and at finished
grade andsupported by 6"X 6"X 6' posts set a min. 4' @ 4' OC secured with (2) W' X 6"
galvanized lag bolts. Regrade disturbed area landward of new bulkhead, place erosion
control blanket and plant with American Beach grass @ V OC. Install 1'X 6'X 12' 316L
stainless steel gabion mattress filled rocks to function as scour pad.

The CAC does Not Support the application because the proposed gabions will not handle
the wave energy'in that area, and the existing vegetation should remain.

RESOLVED to SUPPORT the application of GARY & KATHLEEN ZUAR to construct an
on-grade stone patio on concrete base adjacent to the existing staircase (468 sf.) to
accommodate a BBQ island, bar serving structure and a circular fire pit.

The CAC Supports the application, however the open fire pit it too close to the bluff line
and the beach grasses, and the paved areas should not extend beyond the existing deck
area.

RESOLVED to SUPPORT the application of RICHARD & JEAN JUNG to remove and
replace (in-place and up to 12" higher) approx. 99 If. of existing timber. bulkhead, +/-13'
westerly return, and +/-4' easterly return with vinyl bulkhead and returns; backfill with
approx. 25 cy. of clean sandy fill to be trucked in from an approved upland source; and
establish a 12' wide non-turf buffer adjacent to bulkhead.

RESOLVED to SUPPORT the application of LAWRENCE KAPLAN & DENISE BLESI-
KAPLAN to-construct an in-ground swimming pool 76' from the edge of wetlands and an
on-grade permeable precast patio 68' from the wetlands.

RESOLVED to SUPPORT the application of ANGELIKI KAZEROS & GEORGE PLITAS
to construct proposed 4'X 134' long catwalk supported with 6" dia. untreated piles to gain
access for waters for kayaks, fishing and recreation and avoid disruption to existing
vegetation.

RESOLVED to SUPPORT the application of PABLO PEG, LLC to construct a 16'X 36'
gunite swimming pool and patio approx. 1,006 sf.

The CAC Supports the application with the recommendation the pool is moved landward
10' and in line with the screened porch, and the size of the patio is reduced and
constructed with permeable materials.

RESOLVED to NOT SUPPORT the application of MIMN HOLDING LLC to demolish
existing dwelling and related appurtenances, and to construct a new dwelling (4,919 sf.)
with attached porch (295 sf.) proposed terrace (2,234 sf.), proposed gravel driveway, and
swimming pool (900 sf.). Applicant also proposes to establish and maintain a 10' wide
non-turf buffer along the landward side of the existing edge of clearing, seaward of the
proposed dwelling.

The CAC does Not Support the application because all proposed structures should be
setback at least 1 00' from the wetland boundary and in compliance with Ch. 275.

RESOLVED to SUPPORT the application of CAROLINE TOSCANO to clear a pathway
40'X 4' through non-disturbance area established by DEC and approx. 40' X 4' through
wetland (primarily phragmites). Total area disturbed is 320 sf. Construct a 64'X 4' walkway
w/9 sets of 8" dia. pressure treated pilings and thru flow decking throughout w/staircase.
Install a 3'X 12' aluminum ramp from fixed walkway to floating dock, install an 18.7'X 6'
floating dock with 2'X 4' bump out for ramp with two(2) sets of dauphin pilings on ends for
stability.

The CAC Supports the application with the condition the docking facility does not extend
beyond the pier line.

RESOLVED to SUPPORT the application of KATHLEEN A. HEIDT to reconstruct 43.5 If.
of bulkhead in-place and in-kind (except for proposed vinyl sheathing) and to reconstruct
43.5 If. of existing retaining wall, in-place and in-kind (except for proposed vinyl
sheathing). To replace the existing deck and stairs (in-kind/in-place) at the completion of
the proposed bulkhead/retaining wall reconstruction.

The CAC Supports the application, however questions the permit history of the existing
cantilevered deck, which is not in compliance with Ch. 275. The CAC recommends
removal of the deck if not previously permitted.

RECOMMENDATIONS —APPLICATIONS TO AMEND WETLAND PERMIT &
COASTAL EROSION PERMIT APPLICATIONS
Moved by John Stein, seconded by Inga Van Eysden, it was
RESOLVED to SUPPORT the application of STEVEN EISMAN & VALERIE FEIGEN to
Amend Wetland Permit#9928 to widen driveway to 12' with perimeter 6"X6" pressure
treated beams.to prevent stone migration (as required by DEC). All driveway, repair and
aggregate base course to be bluestone blend on existing subgrade, 2" natural stone to
match beach stone. Area southerly of driveway regraded to create berm to prevent stone
migration (DEC requirement), planted with American Beach grass. Legalize approx. 480 If.
of as-built 2 rail split fence installed with path down lighting at base of posts. Cleared area
B north of driveway replanted with native grass. Cleared area C north of driveway
regraded and planted with a mixture of permitted grasses and plants. Cleared area E
north of driveway has base of concrete turf blocks filled and planted with permitted grass.

RESOLVED to NOT SUPPORT the application of GARDINERS BAY ESTATES HOA to
Amend Wetland Permit#10172 to remove dock fingers B,C & D (168 sf. total). Replace all
three (3) with new floating docks, each 4'X 20'. Maintain existing width of 76' and space B
and C equal distance at 20.67' each. Replace existing floatation system on existing 4'X
76' floating dock with new rubber flotation units. Remove existing wood decking and
replace with marine grade decking. Provide marine grade decking for dock fingers B,C
and D.

The CAC does Not Support the application to extend the docking facility further beyond
the pier line.

RESOLVED to SUPPORT the application of ANDREA COURT HOLDINGS, LLC C/O
JOHN ZEN to Amend Wetland Permit#10042 raise the elevation of proposed residence
from 13.8 to 15.1 and garage elevation to be above 6.1 in response made to comments to
Southold Town Building Dept.

John Stein will attend the next Board of Trustees meeting scheduled for Wed., December
14, 2022.
The next meeting of the Conservation Advisory Council will be held on Wed., January 11,
2023 at 4:30PM in the Conference Room.
There being no further business to come before the Council, the meeting was adjourned
at 6:15 PM.
