WHEREAS, a public hearing was held and concluded on August 22, 1985, in the Matter.of the Application of PAMELA J. SELLARS, Appeal No. 3388; and WHERE~S, the board members have considered all testimony and docu- mentation entered into the reco.rd in this matter, and it is noted that there has been no public opposition; and WHEREAS, the board members are personally familiar with the.premises in question and the surrounding p.roperties; and- ~ WHEREAS, the board made the following findings of fact: 1. By this application, appellant proposes to construct a 18' by 19' garage addition at the northeast section of the existing single-family dwelling which would reduce the easterly sideyard to nine feet and redu.~e the total sideyards to 21± feet. 2. The parcel in question contains an area of approximately 22,000 sq. ft. with 64.63 frontage along Westview Drive, and is improved with single-family, one-story frame house set back from the ea.sterly side at ]2. feet and from the westerly side 12 feet as shown on survey furnished at the hearing dated November 17, 1976. 3. The bulk schedule of the zoning code allows a principal dwelling structure in the "A" Residential and Agricultural Zone to be constructed at not less than 10 feet for one sideyard, and not less than 25 feet total.sideyards. 4. The relief requested by the applicant is one-foot% or 10% 6f'a variance for one sideyard, and four feet, or 16% of a variance for the ~(CONTINUED-ON PAGE TWOI DATED: Sep~mber-g,']g85. 'In considering this appeal, the board has found that this proposal is not unreasonable under the tionally noted below since: in relation to the requirements' of the zoning code; (2i) there will be no substantial change in the character of this district; (3) the relief requested will not cause a substantial effec't of any increased population density Since the property will colntinue to be used for 'single-family purposes; (4) the relief relquested is not detrimental to adjoining properties; . (5) the ciircumstances are unique in ~light of the established narrowness of the lot in question; (6) in view of the manner 'in which the d~fi~iculties arose, there is no other method feasible for the applic~an.t to p_ursue other than a variance; (7). the relief requested ~s the m~nimal necessary. ; · ~~!
