was held 7~30 P.F~. Thursday~ May 54 1960 at the Town Clerk
Office~. Main Road~,. Southold~.~ New York.
There were present~ Messrs. Robert W. Gillispie~. Jr..

Upon application of ~oseph Gutierrez. Jr. ~, 615 South llth
Street. New Hyde Park~. New York. for a variance in accordance
with the Zoning Or~inance.. Article III~, Section 300~ Subsection
7. for permission to locate private garage with reduced setback.
Location of property: west side private road on south side
Bayview Road~, Southold~ New York~ bounded north by Elaine Axien.
east by Gertrude Kuck and right-of-way~, south by Corey Creeks.,
and west by dredged canal. Fee paid $15.00.

The Chairman opened the hearing by reading notice of
disapproval issued by the Building Inspector, application for
a Variance~ legal notice of hearing and affidavit attesting
to its publication in the official newspaper.
THE CJ~AIP~: Is there anyone present who wishes to speak
for this application?
Fir. and Mrs. Joseph Gutierrez, Jr. were present and s~oke
for the application_
Fir. Gutierrez located the present cesspools on the map and
stated he intended at some future date to.locate his cesspools
in the general area where he would place the garage if he located
it 50 ft. from the road, other Suitable locations would interfere
with his lawn and flower beds.
Mr. Nelson Axien informed the Board of Appeals~ through Mr~
Rosenbergby telephone~, thathe would not appear because he felt
whatever the Board decided would be all right with him. It
made no difference where the garage would be placed as far as
he is concerned.

against this application?
(There was no response..)
Resolution was offered by Mr. Gillispie, seconded by Mr.
Bergen and carried, ~ application of Joseph Gutierrez~ Jr.
having be~n considered at Public Hearing No. 271 on May 5~ 1960~
and the Board finding that strict application of the OrdinanceH
no.~
woul~7~roduce undue hardship because there was no hardship shown,.
as the only reason the applicant gave for not placing his garage
within the boundaries permitted by the Ordinance was at some
future date he might wish to place his cesspool in that location
and in other parts of his lot where there was ample room to place
the garage he did not wish to disturb his lawn and flower beds.
The situation is not unique and would be shared by all properties
alike in the immediate vicinity~ because the applicant did not
claim any unique situation~ The public convenience and welfare
and justice Will not be-served and the legally established or
permitted use of neighborhood property and adjacent use districts
would be substantially or permanently injured and the

the spirit of the Ordinance would not be observed because t/~re
are no garages or other out buildings in the neighborhood close
to the road~, therefore~ be it
RESOLVED, that the application be denied~
Vote of the Board: Ayes:- Mr. Gillispie~ Mr.. Bergen~ Mr.
Rosenberg~ and Fir. Grigonis.
Mr, and Mrs. Russell Goodwin appeared before the Board for
an informal discussion, Mr. Goodwin has a junk yard on Depot
Lane, Cutchogue, He stated that he has started a planting and
intendR to continue same, Mr. Caponi who owns the scrap metal
on the property has been ill and absent for three months~ con-
· sequently the metal has accumulated~
On motion of Mr. Grigonis~ seconded by Mr. Bergen, and
carried, it was RESOLVED that the Board of Appeals set 7z30
Thursday~ May 19~ 1960, Town Clerk Office~ Main Road~ Southold~
New Yorkas time and place for hearing upon application of
Frank W. Abrams~ Jr~ for a special exception'in accordance with
the Zoning Ordinance~Article IV~ Section 408~. for permission to
erect and maintain two (2) additional advertiBing signs on the
premises located on the south side of Middle Road and west side
Youngs~Avenue~ South~ld~ New York.
Vote of the Board: Ayes:- Mr. Gillispie~Mr. Bergen# Mr,
Rosenberg, and Mr. Grigonis,

Grigonis and carried~ setting 7:45 P.M. ~. Thursday, May 19~.. 1960~

for hearing ~pon application of Charles Corntburt~ a/c Island's
End Golf and Country Club~ Inc. ~ for a special exception in
accordance with the Zoning Ordinance, Article III, Section 300,
Subsection 11, for permission to erect and maintain an advertising
sign on the premises on north side Main Road (Route 25)~greenport~
New York leased by applicanta, bounded north by lands of applicant,
east by Browns Cabins,._ south by Main Road~ and west by land of
W, Crltchlow and applicant,
Vote of the Board: Ayes=- Mr. Gillispie~. Mr. Bergen,. Mr.
Rosenberg, and Mr. Grigonis.

It was further RESOLVED that legal notice of heantngs be'
published in the official newspaper under date of May 12, 1960.
Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen,. Mr.
Rosen~erg~.. and Mr. Grlgonis.
The Board discussed the proposal of Thomas Jurzenia and Jack
Levin to establish a joint venture directional sign. It was' the
Board's decision that a formal application would have to be made
for each location and the applications should be joint applications
with signatures of all persons who will have space on that particular
locatio$., together with a letter of consent from the property owner
where it is to be located and an application for sign permits with
the exact wording,~, etc. and the order of the motels to be listed
from the town town,~ probably not more than ~ur panels to one set
of posts, but another set of posts alongside if necessary to
accomodate al/-
The next meeting of the Southold Town Board of Appeals will
be held 7:30 PoM., Thursday~ May 12~ 1960 at the Town Clerk Office,.
MainRoad, Southold, New York.
