2.Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal).
3.Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
lions, a certificate of Code compliance from the Architect or Engineer responsible for the building.

ACTION OF THE BOARD OF APPEALS
Application of PETER AND DESPINAMARKOPOULOS for a Variance
to the Zoning Ordinance, Article III, Section 100-31 and prior
Appeal No. 3623 rendered May 11, 1987 for approval of
structure(s) with reduced sideyards, at premises known as Lot
~16, Captain Kidd Estates, along the south side of Sound Beach
Drive, Mattituck, NY; County Tax Map Parcel No. 1000-99-1-24.
WHEREAS, a public hearing was held and concluded on
October 6, 1988 in the Matter of the Application of PETER AND
DESPINA MARKOPOULOS under Application No. 3779; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is referred to as Lot ~16, Map
of Captain Kidd Estates, and is more particularly shown on the
Suffolk County Tax Maps as District 1000, Section 99, Block 1,
Lot 24.
2. The entire premises has frontage along the north side
of Sound Beach Drive 50 feet in length and depth of 150 feet.
The subject premises is presently improved with a new dwelling
structure under construction as permitted by Building Permit
~14198Z dated August 13, 1985.

3. The subject parcel is presently improved with a new
single-family dwelling as depicted on the Septer~ber 1, 1988
survey prepared by Young & Young, L.S., showing setbacks: (a)
at 5.4 feet from the closest point between the westerly side
property line and the outer edge of the six-foot wide deck;
(b) at 10.3 feet at the northeasterly corner of the dwelling at
the easterly sideyard; (c) at 21.7 (10.3 & 11.4) for botk
sideyards.
4. Article III, Section 100-31, Bulk Schedule, Column
"A-40" of the Zoning Code requires minimum sideyards at 10 feet
and 15 feet for a total of 25 feet. By Appeal No. 3297, a
conditional variance was rendered December 13, 1984, permitting
the construction of a principal dwelling structure with
sideyards at not less than 10 feet and 12 feet, and total
sideyards at not less than 22 feet. By Appeal No. 3623, a
conditional amendment was rendered on May 11, 1987, permitting
the reduction of the sideyards at not less than 10.3 feet at the
easterly side and not less than 11.7 feet at the westerly side,
provided there be no further protrusion into either or both
sideyards by any construction (inclusive of steps, etc).
5. The relief requested by this application is
specifically the walkway and step areas as shown on the
September 1, 1988 Survey submitted and considered under this
application.
6. It is the position of this Board that in considering
this application, the nonconformities of the lot and limited
buildable area do lend to the nature of the practical
difficulties. The walkway and step areas are the minimal
necessary and the Board agrees the request is not unreasonable.
7. It is also the opinion of this Board that there be no
further protrusion into either sideyard area to less than that
shown on this Septeraber 1, 1988 Survey, including steps, stoops,
decks, outside shower stalls, or any other obstructions.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Grigonis, it was
RESOLVED, to GRANT a Variance in the Matter of PETER AND
DESPINAMAP/{OPOULOS for approval of the steps and walkway areas
in the westerly sideyard area as applied under Appeal No. 3779
and shown by the September 1, 1988 Survey prepared by Young &
Young, L.S., SUBJECT TO THE FOLLOWING CONDITIONS:

1. There be no further encroachment into either sideyard
2. The easterly sideyard area must remain open and free of
obstructions at all times.

This is an appeal from Article III, Section lO0-31, Bulk Schedule
of the Zoning Ordinance. which requires a minimum of.lO, and ]5-foot
setbacks, fqr a minimum of 25-fqot tot.al sideyard's.for new one-family
dwellings.~n the A-Reside~tia] and Agricultural Zoning District. It
is appl.~cants' reqpest to construct a ne~ one-family dwelling of a
size .2~' W~de..by 42' deep, leaving a 12' setback fr.om the westerly
side line.and 10' setback from the easterly side line, for a total
of 22 feet for both sideyards.
The premises in question fronts along Sound Beach Drive 50 feet
in length~and has a depth of 150 feet. This parcel is known and
~dentified as Lot 16 of Cap.tai~ Kidd Estates.~Subdivision established
Januar9 19, 1949.
It is the opinion of the board in considering this appeal that:
(1) the r.elief'request~d is not substantial in relation to the
zoning requirements, being 11% of a variance; (2) that this request
is not. unyeasonable under, the circumstances;] (3) the circumstances
are unique particularly in light of the dimensions of this parcel;
(4) the va.riance wjll not adversely affect adjoining properties since
the request is minimal; (5) the variance will be in harmony with
and promote the general purposes o~ zoning; (6) and in. light of
the fact that no one appeared testifying that it was important for
the health, safety and welfare of this area that the relief be
denied, it is determined to be within the best interests of justice
to allow the variance, as indicated below.

WHEREAS, a public hearing was held and concluded on April 23,
1987 in the Matter of the Application of PETER MARKOPOULOS under
Application-No. 3297; and
WHEREAS, at said hearing all those who desired to be heard were
heard and their testimony recorded; and
WHEREAS, the board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the board made the following findings of fact:
l. The premises in question is referred to as Lot #16, Map
of Captain Kidd Estates, and is more particularly shown on the
Suffolk County Tax Maps as District 1000, Section 99, Block 1,
Lot 24.
2. The entire premises has a frontage along the north side
of Sound Beach Drive 50 feet in length and depth of 150 feet.
The subject premises is presently improved with a new dwelling
structure under construction as permitted by Building Permit
#14198Z dated August 13, 1985.
