Booth, Jr. and Antonia S. Booth For a Variance to the New York State Uniform Fire Prevention and Building Code INTERMEDIATE DECISION PETITION NO. 264-87-52 On reading and filing the petition made pursuant to 19 NYCRR 440 by Petitioner, and upon receiving evidence and hearing argument thereon at the hearings held at the State Office Building, Veterans Memorial Highway, Hauppauge, New York, on October I, 1987 the Board finding and concluding that strict compliance with 9NYCRR Section 713.1e would create an undue economic burden, the Board grants relief as follows: With respect to a new two-story, wood frame building, of A1 occupancy, having a gross area of 2,200 square feet, and located outside fire limits at 7615 Horton's Lane, Southold, New York, a variance is granted in 9NYCRR 713.1e permitting a headroom over treads of fixed stairs varying from 44" to 68" in lieu of the required 6'-6" headroom height. This Intermediate Decision is to be deemed final by the Code Enforcement Agency and for purposes of the commencement of a proceeding under Article 78 of the Civil Practice Law and Rules by any aggrieved party. In the event of the commencement of such a proceeding, the final decision containing full findlngs of fact and conclusions of law shall ~ssue forthwith,and shall be Petition #264-87-52 page 2 deemed to have been issued on the date below.
