Instructions
A. This application must be filled in typewriter OR ink, and submitted .- I,....~. to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual
natural or topographic featu res.
2. Final approval of Health Dept. of water supply and sewerage disposal-(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable,
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses:
1. Accurate survey of property showing all property lines, streets, buildings and unusual natural or
topographic features.
2. Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.
3. Date of any housing code or safety inspection of buildings or premises, or other pertinent informa-
tion required to prepare a certificate.

WHEREAS,
1985, in the Matter of the Application of
Appeal No. 3401; and
public hearings were held on October 3, 1985 and October 24,
PETER AND HELEN PURIC under
WHEREAS, the board members have personally viewed and are
familiar with the premises in question and the surrounding area; and
WHEREAS, the board has considered all testimony and documentation
submitted concerning this application; and it is noted for the record
that there has been no public opposition; and
WHEREAS, the board made the following findings of fact:
1. The property in question is located on the east side of
Second Street, New Suffolk, New York, contains an area of approxi-
mately 4,075 square feet and frontage (lot width) of 40.10 feet, and
is identified on the Suffolk County Tax Maps as District lO00, Section
117, Block 07, Lot 023.
2. By this application, appellants request a Variance to Article
III, Section 100-31, Bulk ~chedule 'A" for permission to construct an
addition which will extend into the'northerly sideyard area eight
feet, leaving a minimum setback of 13 feet, and a total sideyard are~
of 17 feet.
3. Existing upon the premises is a single-family dwelling which
is presently set back four feet from the southerly sideyard area, 21
feet from the northerly sideyard area, and 15 feet from the front
(westerly) property line. For the record, it is noted that a condi-
tional variance was granted May 27, 1981 under Appeal No. 2821 for
an addition leaving an insufficient rearyard setback at 29 feet.

4. It is also noted for the record that a condi!tional approval
has simultaneously been made under Appeal No.' 3415 t~is date approv-
ing a maximum lot coverage of 23 percent, three percelnt over the
maximum 20% permitted by the Bulk Schedule of the Zon?ng Code (and
conditioned by Appeal No. 2821 of May 27, 1951). i
5. It is the opinion of the board that the reliief requested
for the insufficient sideyard setback of 13 feet and iin~fficient
total sideyards at 17 feet is not unreasonable under ithe circum-
stances. :
In considering this appeal, the board agrees wi~h the
reasoning of appellant since: (a) the relief requested is
not substantial; (b) there will be no substantial change in
the character of this district ; (c) the relief as Iconditionally
granted will not cause a substantial effect o~ detriment to adjoining
properties; (d) the circumstances of this appeal fare unique
and there is no other method feasible for appellants ito pursue other
than a variance; (e) in view of the manner in which the difficulty
arose, justice will be served by allowing the variancle, as indicated
below.
Accordingly, on motion by Mr. Grigonis, seconded] by Mr. Sawicki,
it was
RESOLVED, to GRANT the relief requested under Aplpeal No. 3401
in the Matter of PETER AND HELEN PURIC for permissionl to construct
addition with an i--~-ufficient northly sideyard at 113 feet and
insufficient total sideyards at 17 feet, SUBJECT TO ~HE FOLLOWING
CONDITIONS:
1. No further sideyard or rearyard reductions;
2. Northerly sideyard area of 13 feet shall remain ope~] and
unobstructed at all times for fire and emergency vehi!cles;
3. This approval does not include any variance !which may be
required as to frontyard setback as applied; ~
4. The relief granted hereunder is limited to 113 feet northerly
sideyard area and 17 feet total sideyards. ,
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Doug-
lass and Sawicki. (Member Doyen of Fishers Island w~s absent due
to weather conditions.) This resolution was adopted !by unanimous
vote of all the members present.
