Dear Sir,
As was discuSsed tn our conversation of 9/85, ! am
enclosing a photo copy indicating the change in location of
our septic and well. You indicated that there would be no
problem as the size of our piece of land would easily accommodate
the required distances. Our home is basically centered in'
the middle of the property and we plan to have the septic system
come out the front and the well be out the back.
I have also noticed that Sealand Surveying and Engineering
incorrectly indicated a 50' right of way which does not exist.

Dear Sir,
As per your inquiry with regards to a possible Right'of Way
situate at Horton's Lane, Southold, we have determined the following:
An examination based upon the Schedule "A"'contained in the
Contract of Sale from Overton to Albertson (and executed by both
parties) does not reflect in our chain of title any Right of Way.
If it were the intention of 0verton to grant a Right of Way over
property being conveyed to Albertson, that intention was not con-
tained in Schedule "A" of the Contract of Sale executed by Overton
to Albertson, nor was it reflected in the examination of the records
in the Suffolk County Clerk's Office
Survey ordered by you and submitted to this oI[ice by Sealand
Surveying and dated 12/12/84 does not indicate any such Right of
Way nor does it show property being used for ingress and egress based
on any such Right of Way.
Based upon this search and survey, we issued your client a
title policy free of any Right of Way.~ Our company will stand by
our examination and fully detend any claims made against said property.
This company will endeavor to minimize whatever inconveniences
you or your clients may possibly experience. Accordingly, please
inform anyone who may be making a claim as to a Right of Way over
subject premises to contact this office.

Enclosed please find a copy of a letter that I received from
Peconic Abstract, Inc., the agent for your title insurance
company carrier. Your position is that the S~epnoski's have no
right of way over your property.
Mr. Spanburgh has spoken to their attorney, Mr. Rennsselaer
Terry. Mr. Spanburgh suggested to Mr. Terry that they submit a
claim. He also feels that his reader and your policy, which does
not reflect their right of way, is correct.
