Gillispie Jr. Chairman,Southold Town Board of Appeals Southold, New York Dear Sir: In response to your letter of January 3, 1966 regarding the LBn Jones labor camp, Queens Lane, Greenport our records show the following. Our records are kept only for the latest five years. I~ring that period the camp has not been under permit to Len Jones, though until September 1, 1965 he was the owner. A permit to operate a farm labor camp was issued to Mr. Gillus on June 16, 1961 for this building. In 1962, '63, & '64 the c~ap was under permit to James Brewington and as of September 1, 1965, ~.ake Bolling was the operator and, reportedly, the o~er. Over the years this camp has needed constant supervision to maintain even a marginal compliance with the New York StAte Sanitary Code, but in recent months, though far from oerfect, the level of compliance has sho~ considerable improvement. Inspections by our etaff were made on, 8/6, 8/9, 9/1, 10/6, 10/29, 12/6, and December 22, 1965. A permit for 1966 was approved on January 13, 1966o As of December 22, 1965 the camp wae occupied byl8 men. If I can be of Ilkrther sea, ice, please feel free to ca}~. Very truly yours, Calvin M. These considerations are to be reviewed completely at the time of application. Full considera- tion in placement of water supply wells and disposal systems is given to State and Town wetland requirements. The Health Depart-' ment maintains ~jurisdiction over final location of disposal and well systems and the applicant should not undertake to construct any water supplly or disposal system without Health Department approval. The Lead Agency is requested to forward a copy of this form to the applicant with its findings. Further comment may be,iprovided upon completion of the application review. T D LD Southold, N.Y. 11971 (516) 765-1938 August 5, 1986 NEGATIVE DECLARATION Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that South61d Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Richard and Anita Wilton is for two lots onl.8471 acres located at Queen Street for single family residences, tax map no. 1000-40-3-6. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The Suffolk County Department of Health Services has no objection to our designation of lead agency status. There is not record of an application to this Department. The Health Department does require an application to construct prior to further review. It appears that the proposed action conforms to the minimum lot size requirement for Article 6 (Suffolk County Sanitary Code). Because there has been no correspondence from the Department of Environmental Conservation in the alotted time, it is assumed that there are no comments nor objections from that agency. This project conforms to the Southold Town Code for Subdivision Regulations. Any further information can be obtained by contacting Diane M. Bruer, Esq for Papadopoulos and Maragos Richard Lark, Esq for Richard and Anita Wilton Supervisor Francis J. Murphy DATED: May 9, ]986. Form ZB4 (rev. 12/81) CHAIRMAN, SOUTHOLD TOWN ZONING BOARD OF APPEALS Page 2 Appeal No. 3456 Matter of RICHARD AND ANITA WILTON Decision Rendered April 16, 1986 of 40,000 sq. ft. in area and average depth of 218.63 feet, (b) Lot #2 of 40,460 sq. ft. in area and average depth of' 197.24 feet. 4. For the record it is noted that the prior n~nconforming use of this premises as a preexisting nonfarm labor ~amp has been terminated for a number of years, and that the parcel will be used for such single-family purposes as permitted bylthe current zoning regulations in this "A-40" Residential and Agricultural Zoning District. 5. The board finds that the relief requested i~ not unreason- able. The parcels generally existing along the east~side of Queens Street to the north of this parcel are substantially smaller 'than that proposed by this application. · In considering this appeal, the board finds andidetermines: (a) that the relief requested is not substantial inirelation to the conditions generally existing in the'immediate area; (b) that the circumstances are unique; (c) that the variance will not in turn cause a substantial effect of increased population density or be adverse to the safety, health, welfare, comfort, convenience and order of the town; (d) the information submitted i$ sufficient to warrant a granting of the variance~ (e) in denying the relief requested, the interests of justice would not be served. Accordingly, on motion by Mr. Goehrin~er, seconded by Mr. Grigonis, it was .... RESOLVED, that the relief as applied in the App.lication of RICHARD AND ANITA WILTON under Appeal No. 3456 for approval of insufficient lot area and lot depth of: (a) Lot No.! 1 of 40,000" sq. ft. and average depth of 218.63 feet, and (b) L'ot No. 2 of 40,460 sq. ft. and average depth of 197.24 feet, as shown on survey updated December 10, 1985, by Young & Young, .L.S., B~E AND HEREBY IS GRANTED SUBJECT TO THE FOLLOWING CONDITIONS: 1. Large frame building, if not demolished, must be brought up the current standards for a principal single-famiily dwelling structure, in conformance with all health, building, sanitary and building codes; : 2. "Framed shack" structure may remain if used only as an accessory structure incidental to residential use of the premises, 3. Approvals for city/public water and sewer On Lot #1; 4. Approval for city/public water on Lot #2; 5. Previous nonconforming use as a nonfarm labor camp shall remain terminated, not to be reesablished. Vote of the Board: Ayes: Messrs. Goehringer,iDoyen and Grigonis. (Members Sawicki and Douglass were absent.) This resolution was duly adopted. lk GERARD P. RFL/mld Enclosures Very truly your~s, APPEAL TO THE ZONING BOARD OF APPEALS. OF T~E TOWN OF SOUT~OLD, N.Y. BY RICHARD C. WILTON AND ~ITA C. WILTON RIDER TO R~ASON FOR APPEAL QUESTION continued: petitioners are t~e owners and .operators of this sucoessful campground, and by building their home adjacent to the campground they will be able to exercise better control and still have some family life. The Village of Greenport owns most of the property Co the east of your petitioners' property, and ,a portion to the east is owned by Daniel G. Conklin. In all lik~iihood, th~ property owned by the Village of Greenport will never be developed. The area variance request for two building lots is not substantial in relation to the current zoning r~quirements, taking into considera- tion the proposed Master Plan Update which provides for this property to be zoned Aow Density Residential R-40 District. This proposed~, zoning provides for one dwelling per acre. AS this neighborhood is already deve~ped with four residential .lots on Queen Street on parcels smaller than one acre, one acre density for the balance of the property in this neighborhood~is appropriate. Tt~ere will be no significant increase in population density to burden governmental facilities, and there will ,be no substantial change in the character of the neighborhood. If anything, taking into consideration the removal of the migrant labor camp which previously housed as many as 20 farm w~rkers, it will be an upgrading from the previous use of the property. It is respectfull~ submitted that substantial justice will be served by granting this application, as there will be no further development of this neighborhood. Richard C. Wilton ~nita C.
