Dear Ms. Neimetz:
The Southold Town Board of Trustees reviewed your letter received in this office on
September 6, 2022; along with the site plan prepared by Daniel R. Falasco, P.E., P.C.,
dated August 10, 2022. At your request a site visit was made to the property on
September 7, 2022 and we have determined that the proposed installation of new septic
system which is to be located on the landward side of your residence, to be out of the
Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of
the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required.
Please be advised, however, that no clearing, no removal of vegetation, no cut or
fill of land or removal of sod, no construction, sedimentation, or disturbance of
any kind may take place within 100' landward from the top of the bluff, or seaward
of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the
coastal erosion hazard area as indicated above, without further application to,
and written authorization from, the Southold Town Board of Trustees pursuant to
Chapter 275 and/or Chapter 111 of the Town Code.
It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result

from your project. Such precautions may include maintaining adequate work area
between the tidal wetland jurisdictional boundary and the coastal erosion hazard area
and your project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Members of the Board of Trustees,
My husband Jean-Marc Neimetz and I bought the property at 9425 Soundview.Avenue
last year under an LLC. It is a very old house built in approximately 1965 that requires
several repairs and updating.
We discovered last month that the cesspool that dates back to the 1960's is falling apart
as we found a big hole where bricks should have been covering the top. We
immediately called in an engineer and applied to the Health Department for an
emergency situation approval, and they have approved the plans but have asked that
we get approval also from the Board of Trustees.
Our plans have put the new septic tank at the front of the house very far away from the
water. The current cesspool that is much closer will be abandoned.
We are also planning to add on addition to the house as part of the update but have not
yet submitted plans to the town and we apprised the Board of Health of this.
We are therefore requesting you to kindly visit our property tomorrow September 7th,
2022 before we submit our application to you formally and request that you accept this
letter as our permission to you to visit our property.

This office has reviewed your application for existing or proposed sewage
disposal and/or water supply systems, or your application for a subdivision for the
above referenced project. The following will be required prior to any further
.processing -of the-a.p.p.licatio.n.for approval to-construct:
1) Submit NYSDEC approval.
2) Submit Town Wetlands approval.
3) The top of the leaching galley can be a maximum of 2.5' below grade.
The galley is currently proposed 3' below grade, please revise.
4) Provide buoyancy calculations for the pump station.
5) The site plans-appear to show a circle in the ear of the property with
two overhead electric lines running to it. Please label this structure.
6) Show the location of the existing well and label it to be abandoned.
7) The grading plan appears to show the bottom elevation of the leaching
galley to be both elevation 7.5' and 4.3'. It appears the 7.5' is the
intended elevation. Please verify and revise grading plan.
To avoid delays in the processing/approval of your application, paperwork and
documents should be submitted using the online portal. Electronic submission will
ensure priority processing.
Please note that alterations of surveys/plans must be made by a licensed design
professional or surveyor and be properly certified. Photocopies of documents and
