That the Party of the First Part, in consideration of Ten ($10.00) Dollars, lawful
money of the United States, and other good and valuable consideration, paid by the
Party of the Second Part, does hereby grant and release unto the Party of the Second
Part, the heirs, successors and/or assigns of the Party of the Second Part forever.
All that certain plot, piece or parcel of real property, together with the
improvements erected thereon, situate, lying and being a condominium unit in
Cutchogue, Town of Southold, County of Suffolk and State of New York, known and
designated as Unit Number (or sometimes Home Number) 56 (the "Home") in the
condominium known as Harvest Pointe Condominium II (the "Condominium"), said
Home more particularly defined, designated and described in the Declaration of the
Condominium made by The Party of the First Part establishing a plan for condominium
ownership of said premises under Article 9-B of the Real Property Law of the State of
New York, dated July 8, 2020 and recorded in the Office of the Clerk of the County of
Suffolk on September 28, 2020 in Liber D00013072 at Page 581 (the "Declaration"),
designated as District 1000 Section 102.01 Block 02.00 Lot 030.000, on the Land and
Tax Map of the County of Suffolk and as shown on the Map of the Condominium,
prepared and certified by Glen Robert Cherveny, New York State Registered Architect,
filed in the Office of the Clerk of the County of Suffolk on September 28, 2020 as Map
No. 490.
TOGETHER with an undivided 1.6667% interest for the Home in the Common
Elements(as defined in the Declaration)of the Condominium.
BEING AND INTENDED TO BE part of the premises conveyed to the Party of
the First Part by deed made by Nocro, Ltd. dated March 31, 2017 and recorded in the
J Office of the'Clerk of the County of Suffolk on April 27, 2017 in Liber 12910 at Page
370.
TOGETHER with the appurtenances and all the estate and rights of the Party of
the First Part in and to the Home.

Association, Inc. (the"Association").

burdens, covenants, restrictions, by-laws, rules, regulations and easements all as set
forth in the documents with respect to the Condominium filed and recorded as
aforesaid.
SUBJECT TO: the provisions of the Declaration, By-Laws, site plan and floor
plans of the Condominium and the Declaration of Covenants, Restrictions, Easements,
Charges and Liens recorded January 9, 2018 in the Office of the Clerk of Suffolk County
in Liber D00012945 Page 278, and By-Laws of the Association, as the same may be
further amended from time to time by instruments recorded or filed in the Office of the
Clerk of the County of Suffolk, which provisions, together with any amendments thereto
shall bind any person having at any time any interest or estate in the Home, as though

SUBJECT TO: that certain Declaration of Covenants and Restrictions, made by
Rimor Development LLC, dated July 31, 2017, and recorded in the Office of the Clerk of
the County of Suffolk on August 9, 2017 in Liber D00012924 Page 139.
SUBJECT TO: that certain Declaration of Covenants and Restrictions, made by
Rimor Development LLC, dated September 19, 2017, and recorded in the Office of the
Clerk of the County of Suffolk on September 21, 2017 in Liber D00012930 Page 554, as
amended by Amended Declaration of Covenants and restrictions dated February 19,
2019 and recorded February 20, 2019 in Liber 13001 Page 543.
SUBJECT TO: any and all other covenants, restrictions, reservations, waivers,

Part, the heirs or successors and/or assigns of the Party of the Second Part forever.
AND the Party of the First Part covenants that the Party of the First Part has not
done or suffered anything whereby the Home has been encumbered in any way
whatsoever, except as aforesaid.
AND the Party of the First Part, in compliance with Section 13 of the Lien Law of
the State of New York, covenants that the Party of the First Part will receive the
consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purposes.
The use for which the Home is intended is that of a one family residence, subject
to the applicable governmental regulations, zoning requirements and covenants and
restrictions of record including, without limitation, those regarding age and occupancy,
the restrictions contained in the Declaration and the By-Laws of the Condominium and
the restrictions contained in the Declaration of Covenants, Restrictions, Easements,
Charges and Liens of the Association and the By-Laws of the Association, as same may
be amended from time to time.
This conveyance has been made in the regular course of business actually
conducted by the Party of the First Part.
The word "Party" shall be construed as if it read "Parties" whenever the sense of
this Indenture so requires.
