APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of i% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

Dear Mr. Fish:
We are attorneys for the executors of the will of
Joseph F. Woglom, Jr. The Woglom property in East Marion
contains a swimming pool for which the above referenced building
permit was issued. Although the pool has been completed, a
Certificate of Occupancy has not been issued.
As you know, we are now attempting to obtain the
Certificate of Occupancy for the swimming pool. Pursuant to our
telephone conversation yesterday, and at your request, I enclose
the following:
Application for Certificate of Occupancy, duly signed
by the executor
Amended survey of the Woglom property reflecting the
location of the pool
Our check to your order in the amount of $25.00
It is my understanding that, upon receipt of the enclosed, you
will actually visit the Woglom property to inspect the pool area.

Ladies and Gentlemen:
Please be advised that I and V. Anthony Maggipinto, Esq. represent
Mr. and Mrs. Swick who own property abutting the construction site
which is the subject of the above-referenced permit. We ask that
you review your file and actions in this matter.
The survey attached to the building permit application and the
markings thereon appear to be unacceptable as a matter of law.
Section 7209(1) of the Education Law requires all surveys filed
with your office to be prepared and sealed by a licensed land
surveyor. This does not appear to be the case here. Section
7209(2) prohibits any alteration to the surveyor's work. This
appears to have been done in this instance.
The permit application in your file shows a sixty foot set-back be-
tween the pool and the northerly lot line of the subject parcel. I
enclose a clean copy of the survey of that property. By scale
there appears to be 75+ feet between the house and the lot line.
Unless the pool and appurtenate structures are less than 15+ feet
wide, there is an error in the application and/or permit. We are
advised by our clients that the work appears to be much closer to
the lot line than 60 feet. Please review this item and conduct a
field inspection of the work.
If any or all of the above is found to be in violation, please
issue the appropriate stop work order and/or recission of the
building permit.

Our inspector Gary Fish did the inspection on the pool.
Everything is O.K. for the C.O. however he is requesting a
survey of the accurate location of the pool as it was install-
ed. He is asking for this because of a letter in the file from
Allen M. Smith who represented Mr. & Mrs. Swick. I am enclosing
a copy of this letter.
Please mail us along with the survey your application and
check for the C.O. Thank you.

INSTRUCTIONS
a. This application must be completely filled in by typewriter or in ink and submitted to the Building Inspector, with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-
cation.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issued a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until ~t Certificate of Occupancy
shall have been granted by the Building Inspector.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
