Gantly -~ Barkers Point Road Sands Point, NY 11050 April 20, 1987 Southold Building Department Southold Town Hall Main Road Southold, New York 11971 Attn: Mr. Curt Horton Dear Curt: In confirmation of our telephone conversation today, you said that you would put my correspondence dated'January 13 and April 8, 1987 in the file of the new house under construction adjacent to Mrs. Gantly's property, Section-Block-LotS 111-8-12, on Nassau Point Road; and that you would make a note on this correspondence to see Curt Horton. Therefore when the owner or builder comes into your department regarding that property, it will be a reminder that they should ask for you who is familiar with the situation as outlined in my correspondence as well as our last two phone conversations, whereby you will remind them to put fill in our property to rectify the terrain problem they caused as a result of utilizing a bulldozer to pull the hill down to create a level piece thus leaving a large cavity on Mrs. Gantly's lot. During our discussion I explained the situation concerning the lot adjacent to Mrs. Gantly's property. I appreciate your attention to this matter at your earliest convenience as our inquiry to the Southold Building Department dates back to October of last year. Neither Messrs. Lessard or Tasker have re- plied to our correspondence. I met with Helen Devoe in your offices on Friday, April 3 and was informed that there was no file on the attached letter. Helen was very nice and helpful during our review of the situation. Both you and Mr. Lessard as well as my brief meeting with Helen this past weekend all agreed that the situation causea by the adjacent property owner shoula be rectified. My frustration is that I don't get any communication from the building department. I will call you on April 20th. John P. Gantly John P. Gantly Barkers Point Road Sands Point, NY 11050 January 13, 1987 Southold Building Department Southold Town Hall Main Road Southold, New York 11971 Attn: Mr. Victor Lessard Dear Mr. Lessard: In as much as over two months have elapsed since Mrs. Gantly originally brought her concerns to you regarding property that she owns on*Nassau Point Road, I am writing in the hopes that my written inquiry will illicit some comments from your office as any attempts at phone conversations with you have failed to re- solve this matter. You may recall that during our last conversation in early December 1986, you indicated to me that, based upon a review of construction on the property ad- jacent to our lot, a certificate of occupancy would be denied until you were satisfied that all irregularities had been corrected. You stated that the building inspector who had reviewed the construction had conversed with the builder on the site and was advised by him that any terrain modification /detrimental to our lot would be redesigned. You indicated to me that you felt our concerns were justified and that you planned to take this matter up with legal counsel for the Town of $outhold. You requested that i call you in one week's time for a progress report. Sympathizing with your busy schedule, I waited two weeks before attempting to contact you, fully believing that at this time you would have some constructive information to report. I was indeed frustrated when once again on December 29, I had to describe the situation to Mrs. Devoe who assured me that you would return my call, an event which still has not occurred. At this particular point in time, construction on the lot adjacent to ours is nearly completed. We initially brought this ~atter to your attention prior to the commencement of any foundation construction. It seems to me that an un- reasonable amount of time has elapsed. We respectfully request that you now advise us of the steps that you have taken to insure that the integrity of our lot is maintained. We await your written comments. John P.
