Instructions
This application must be filled m typewriter OR ink, and submitted ..~ to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property w~th accurate location of all buildings, property lines, streets, and unusual
natural or topographic featu res.
2, Final approval of Health Dept. of water supply and sewerage dmposal-(S-9 form or equal).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Commerclal buildings, industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.
B For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre-existing"
land uses.

Dear Mr. Sgouros:
Since the filing of your application on February 28,
1986, we have discussed and researched the history of your
property with Victor Lessard, Executive Administrator
(Building Department), and its approval by the Major
Subdivision Map signed September 19, 1963 by the Southold
Town Planning Board (for both Lots #22 and #23).
Mr. Lessard has ~ndicated that he agrees there are
exceptions by Article III, Section lO0-31(B)[1], page 10028
of the Zoning Code, for "All lots shown on magor ...subdivi-
sion maps which were granted approval by the Planning Board
prior to May 20, 1983."
By way of a copy of this letter, we are requesting
recons~deratTon by the Building Department of their Notice
of Disapproval dated February 21, 1986, in th~s regard.

Subdivision Map No. 3864, approved by the Planning Board 9-19-1963,
having insufficient area, width and depth, located a~ong the West
Side of Stars Road, East Marion, NY; County Tax Map Parcels No.
1000-22-2-20 and 21.
WHEREAS, public hearings were held on May l, 1986 and May
1986, in the Matter of the Application of JOHN P. SGOUROS under
Appeal No. 3479; and

the surrounding areas; and
personally viewed and are
its present zoning, and
WHEREAS, at said hearing all those who desired to be heard
were heard, and their testimony was recorded, and
WHEREAS, the board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the board made the following findings of fact:
l. The premises in question is located in the "A" Resi-
dential and Agricultural Zoning Distr~ct along the west side
of Stars Road, in the Hamlet of East Mar~on, more particularly
known and identified as Subdivision Lots 22 and z3 on the
"Map of Stars Manor," approved by the Southold Town Planning
Board September 19, 1963, and as County Tax Map Parcels
No. 1000, Section 22, Block 2, Lots 20 and 21.
2. The subject premises as a whole consists of a total
area of one acre with 208± feet along Stars Road and Is presently
unimproved.
3. By this application, appellant requests approval of

the reseparatlon ot Subdivision Lots #22 and #25 as existed
prior to 1~71. The lots are shown on map prepared by Roder~ck
VanTuyl, P.C., dated February 27, 1986, as follows: (a) Lot
#2, or Subdivision Lot #22, of an area of 2~,938 sq. ft., front-
age along Stars Road ot 140± feet, and lot depth of 120 feet;
(b) Lot #1, or Subdivision Lot #23 of an area of 20,210 sq. ft.,
frontage of 168.42 feet, and lot depth of lzO feet.
4. ~ubm~tted for the record by applicant are: ia) cop~es
of two separate tax bills for the two parcels, (b) cop~es of
two deeds, at Llber 9722 cp 531 and at L~ber 9722 cp b33, dated
December 26, 1984, showing conveyances from Pantells Sgouros
to John Panos Sgouros.
5, It is also noted that by letter dated May l~, 1986,
an opinion was received from the Town Attorney indicating that
although Planning Board approval was given in 1963, the lots
do not meet the requirements of Article III, Section lO0-31(A)
since each lot was not "held ~n single and separate ownership
prior to November, 1971, and thereafter...," and are therefore
governed by Column 40(A) of the Bulk and Parking Schedule,
requiring this variance.
6. The character of the lots along the west and east s~des
o? Stars Road ~s lots of a s~m~lar size to that proposed by th~s
request. _
In considering th~s appeal, the board also f~nds and
determines: (a) that sufficient practical d~fflcult~es have
been shown to warrant the granting of this variance, {b) the
circumstances are unique and not shared by all other properties
in the neighborhood; (c) there w~ll be no substantial change
~n the character ot the neighborhood or detriment to adjoining
properties; (d) the relief requested ~s not substantial;
(e) the difficulty cannot be obviated by some method feasible
for appellant to pursue other than a var~ance~ (f) that ~he
variance will not ~n turn cause a substantial effect of increased
population density or be adverse to the safety, health, weflare,
comfort, convenience and order of the town; (g) that ~n
view of the manner in which the difficulty arose and in con-
siderat~on of all the above factors, the ~nterests of justice
w~l best be served by allowing the variance, as conditionally
noted below.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Douglass, it was
