KENNEY for a Variance to the Zoning Ordinance, Article III, Section 100-31, Bulk Schedule, for permission to o~struct deck addition to dwelling with an insufficient rearyard setback at premises identified as 2320 Gillette Drive, East Marion, NY; Marion Manor Subdivision, Filed Map 2038, Lot ll; County Tax Map Parcel No. 1000-38-02-024. WHEREAS, a public hearing was held and concluded on July 18, 1985, in the Matter of the Application of ROBERT N. KENNEY; and WHEREAS, the board members have considered all testimony and documentation entered into the record in this matter, and it is noted for the record that there has been no opposition entered concerning this appeal application; and WHEREAS, the board members are personally familiar with the premises in question and the surrounding properties; and WHEREAS, the board made the following findings of fact: 1. This is an application for an area variance for to place a proposed lO' by 20' deck addition at the rear of the existing dwelling, with an insuffi~cient setback at permission (westerly) 26½ feet. 2. The parcel in question is known and' identified as Lot ll, Marion Manor Fi]ed Subdivision Map 2038, located on the west side of Gillette Drive, East Marion; County Tax Map District lO00, Section ~8, Block 02, Lot 024. 3. The subject premises is presently improved with a single- family frame house with setbacks from the f.ront property line at 35 feet and from the rear property line at 36½ feet. The parcel fronts along Gillette Drive 105 feet and has a depth of 100 feet. 4. It is the opinion of the board that'the ten-foot deck ~CONTINUED ON PAGE TWO) DATED: August 9, 1985. KENNEY Decision R~-n~'~ugu~t~, 1985 addition as applied is not unreasonable consideringl the substandard size of this parcel, the feasible placement of the ~welling, and the limited buiidi~g area for the principal building. In considering this appeal, the board determiI~es that the relief be approved as requested for the reasonsl stated above and (1) the deck addition will not substantially a!ter the character of the district; (2) the deck will not be adverse to adjoining properties: (3) the variance will not cause a substantial effect of increased population density;i (4) in view of the substandard size of this parcel and conforming setbacks of the dwelling.as exists, the difficulty cannot be!obviated by some method feasible to appellant to pursue othe¢ than a variance; (5) the relief requested is not substantial in rela- tion to the zoning requirements; (6) in view of the manner in which the difficulty arose and in consideration the above factors, the interest of justice will be served variance, as noted below. Accordingly, on motion by Mr. Goehringer, Mr. Sawicki, it was of by allowing the seconded by RESOLVED, that the relief requested under Appeal No. 3370 in the Matter of the Application of ROBERT N. KENNEY to con- struct a 10' by 20' deck addition w~th a setback from the rear property line at 26½ feet as requested and SUBJECT ~0 THE FOLLOW- ING CONDITIONS: '--~ ..... 1.
