Dear Sir:
I am wrzting to you, with reference to the
septic system that you have presently installed for
the new dwelling you have in construction. Compar-
ing this with the septic system approved, by the
town, I find serious changes and feel that what has
been presently installed zs not compatible with what
was approved and is not acceptable. This problem
will have to be resolved before a Certificate of Oc-
cupancy will be issued for this residence,

Dear Szr:
On June 9, 1987 I wrote you about the septzc system
you had installed in your new dwelling. I also telephoned
the Suffolk County Health Department who indzcated changes
were made, which they had approved of, and would forward
same to this department. Thzs, to date, has not happened.
Now you submit a survey, with the Health Department final
approval. Survey does not show cesspool pro3ections above
the road or how far down zn ground the concrete retazning
wall was installed to prevent leaching under and out znto
town road. These znquiries must be satisfied before any
consideration of Certificate of Occupancy.

Dear Victor:
Mr. Bredemeyer has referred your Order to Remedy Violation to me. He
advised that he has a removable shutter to protect the sliding glass doors
on the water side. The shutter may have been mistaken for a deck when
opened.
Since the Bredemeyers are now away, the shutter is closed. On their
return, I will discuss with them any alternatives to leaving it down on the
ground during the summer months.

Dear Vic:
Mr. and Mrs. Bredemeyer have consulted me regarding your letter to them of
September 14, 1988. It was the Bredemeyer's understanding that this matter was
resolved in the Spring of 1987. At that time, they gave you a copy of a letter from
the Suffolk County Department of Health Services dated April 13, 1987, copy enclosed,
showing that the Health Department had approved certain changes to the septic system.
This letter was the result of a site inspection by both Mr. Reynolds and Stephen A.
Costa, Chief of the Bureau of Wastewater Management. They respected the pools
which had been installed and determined that the pools could be lowered by one (1)
foot. Subsequent to that, the Bredemeyers met with you on May 27, i987 at which
time they advised you of the above and you spoke to Mr. Costa at the Health Department
by telephone and appeared satisfied with the changes.
As to the final mstallation, I have been advised that the septic system has been
lowered one (1) foot from the original plan and has been approved by the Department
of Health Serwces. A copy of the stamped approved map is enclosed. The pool covers
are about one (I) foot below grade, and are approximately twelve inches (12") thick
as they are commercial, heavy grade covers. The rings are two (2) feet and are located
approximately two (2) feet below grade and at least two (2) feet above water level.
The retalmng wall along the street is approximately two (2) feet above the street
level and goes approximately two (2) feet below grade, at a depth equal to the bottom
of the pools. The top of the r~ngs are located below the original grade of the lot.
Upon reviewing your letter of September 14, 1988, I telephoned Mr. Costa,
who confirmed that the Health Department has approved the septic system. He advised
that the Health Department has not required the items requested in your letter, probably
due to the age of the application and the fact that the Board of Review did not require
them. However, he assured me that the installation was satisfactory to Health Department
standards and that consequently they are not concerned that there may be problems
of leaching onto Town property.
I trust this will answer your inquiry, and would appreciate your adwsing immediately
if you have any other questions.

Followlng our telephone conversation on October 21, 1988, in which
you indicated that your concern was that the retaining walls were not built
to the depth of the cesspool rings, but only to the top of the rings, I
obtained pictures and a letter from Mr. Bredemeyer that the wails were
~n fact constructed as deep as the lower level of the pools. I delivered
the affidavits and photocopies of the pictures to your office on October
25, 1988, but Helen advised that you would be cn vacation until this week.
I believe this ~nformation answers your concern regarding the construction.

Dear Mr. Lessard:
Enclosed zs a sketch for a proposed house on Bay Avenue
in Orient. We would appreciate your sending us a notice of
disapproval for any items which do not comply with the Zoning
Code. Although the house is set back only 15 feet from the
street, it is no closer to the street than the houses on the
surrounding properties.

Dear Mr. Lessard:
I am the owner of the property at the west side of Bay
Avenue, Orient, New York.
I personally witnessed the installation of the
cesspools ~nd retaining wall. The cesspool consists of a
three (3) foot ring and the bottom foot was filled with sand
pursuant to approvals of the Suffolk County Health
Dep~rt~ent. The remaining two (2) feet of the ring are
located below the original grade of the lot.
The retaining wall is reinforced, poured concrete and
was constructed at a depth of two (2) feet below the
original grade (i.e., two (2) feet below street level). The
bottom of the retaining wall is at the same depth as the
bottom of the functioning level of the pool.

Application of JOHN AND JEANNE BREDEMEYER for a Variance to the
Zoning Ordinance, Article XI, Section 100-119.2 for permission to
locate single-family dwelling structure within 75 feet of ordinary
highwater mark along Orient Harbor. Locatton of Property: West Side
of Bay Avenue, Orient, NY; County Tax Map Parcel No. 1000-26-1-8.
WHEREAS, public hearings were held on August 14, 1986, and
September ll, 1986 ~n the Matter of the Application of JOHN AND
JEAN BREDEMEYER under Appeal No. 3533; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, ]ts present zoning, and
the surrounding areas; and
WHEREAS, the board made the following findings of fact:
1. The premises in question is a described parcel containing
a total area of 6,300 sq. ft., frontage (lot width) along the
west side of Bay Avenue of 111.67 feet, lot depth along the south-
erly property line 52 feet and along the northerly property line
74 feet.
2. The subject premises is vacant and is more particularly
shown and identified on the Suffolk County Tax Maps as D~str~ct
1000, Section 26, Block 1, Lot 18.
3. Article XI, Section 100-119.2, sub-paragraph B, requires
all buildings proposed on lots adjacent to tidal water bodies
other than the Long Island Sound to be set back not less than
seventy-five (75) feet from the ordinary h]ghwater mark of such

whichever is greater.
4. By this application, appellants propose to locate a
22' by 57' single-family dwelling structure with setbacks as
follow: (a) from the front property line along Bay Avenue at
15 feet, (b) from the existing concrete bulkhead at the rear
of the premises at 13 feet, and slx feet at its closest point,
(c} from the northerly side at 20 feet and southerly side
at 27 feet. The setback of the garage section of the proposed
structure will be 14 feet from the ordinary highwater mark (rear
property line) at {ts closest point and 27 feet from the
northwesterly corner of the proposed dwelling.
5. It is noted for the record that: (a) by action taken
May 29, 1986, the Southold Town Trustees approved this project
under Wetland Application #358; (b) letter from the N.Y.S.
Department of Environmental Conservation, TW #15276-0287,
indicates that no permit under Article 25 is required; (c)
the elevation of the lowest floor with utilities, or first
floor, will be not less than nine feet above mean sea level
all as required by Chapter 46 of the Floodplain Law, (d)
Certificate of Occupancy #Z14922 was issued September 30, 1986
by the Southold Town Building Department.
6. It is also noted for the record that relief for
the frontyard setback is not necessary inasmuch as the
setback proposed is the same as the established dwelling
to the south and will meet the requirements of Section 100-33.
7. T~e relief requested is the minimal necessary in v~ew
of the character and dimensions of this lot.
In considering this appeal, the board finds and determines:
(a) that the relief requested is not substantial ~n relation
to those setbacks generally established in this vicinity; (b)
the practical difficulties claimed are sufficient to warrant
a granting of the relief requested; (c) there will be no
substantial change ~n the character of the distr~ct; (d)
the circumstances are unique; (e) there is no other method
feasible for appellant to pursue other than variances; (f)
that in view of the manner in which the difficulties arose and
in consideration of all the above factors, the interests of
justice will be served by allowing the relief, as conditionally
noted below.
Accordingly, on motion by Mr. Sawicki, seconded by
Mr. Gr~gonls, it was
RESOLVED, to approve the relief requested under Appeal
No. 3533 in the Matter of JOHN AND JEANNE BREDEMEYER as
applied and depicted by survey revised May 12, 1986 prepared
by Roder~ck VanTuyl, P.C., SUBJECT TO THE FOLLOWING CONDITIONS:
l. Compliance with the lowest-floor elevation requirement
of the Floodplain Management Law;
2. No fill to be
extend over the height
