Southold, N,Y. 11971 (516) 765-19~8 MEMO RAND' UM TO: FROM: DATE: RE: Victor Lessard, Executive Administrator Valerie Scopaz, Town Planner November 4, 1987 Angel Shores Water Supply Facility and Building Permit for Same It is the Planning Board's determination that the building permit issued for construction of a water supply facility should be issued for the entire site as a whole (SCTM ~ 1000- 88-6-13.1,5, and 4) since all this property together is the subject of a pending subdivision application known as Angel Shores. It should be noted for the record that the subdivision layout that was submitted to your office as:~part of this building permit application has no status whatsoever. First, it does not include all of the property that is the subject of the subdivision application under Mr. Laodis' name. Second, Mr. Laodis has been asked to file an environmental impact statement for the proposed subdivision. The Planning Board has not endorsed or approved any layout of Angel Shores. Therefore, any building permit issued by your office should clearly state that the subdivision map submitted with the permit application has no status. The permit should also include all the property within the subdivision (SCTM# 1000-88-6-13.1, 5, and 4). For you own records it is suggested that you ask the applicant to provide your office with a survey of the entire premises under the Angel Shores proposal. STATE ENERGY CODE FINAL ADDITIONAL COMMENTS WHEREAS, Laoudis and Cove have entered into an agreement relating to the use and ownership of the Water Supply Area, and the construction and operation of a joint water system, Exhibit L, which agreement also provides for the formation of a Homeowner's Association ("Association"), to lease, use and own the water system including the Water Supply Area, and WHEREAS, as part of the agreement, Cove has agreed at its own cost and expense to construct a water system including the wells, well house and storage tank, but excluding the mains, distribution lines, fittings and valves, in substantial accordance with the plans and specifications prepared by Henderson and Bodwell, Exhibit B, and approved by H2M ("Plans"), the water system contemplated by the plans, including the distribution lines, is referred to hereinafter as the Water System, and WHEREAS, Cove and Laoudis have each agreed at its own cost and expense to lay and install or cause to be installed the mains, distribution lines, fittings and valves substantially as shown on Exhibits C and D, and Exhibits H and I, respectively, and to give and procure easements for the maintenance of the water system, for their respective premises, and WHEREAS, Laoudis has agreed to lease, grant an easement and deed the Water Supply Area to the Association, and WHEREAS, the Village has resolved to operate, repair, maintain and replace Cove and Laoudis' Water System at the expense of the Association; NOW, THEREFORE, in consideration of the covenants contained herein, it is mutually agreed as follows: 1. Cove will install,' at its own cost and expense, the Water System, including the mains and distribution lines to the Condominium (but excluding the mains and distribution lines for Angel Shores) in substantial accordance with the Plans and Exhibits B, C and D, including all necessary engineering work, such as trenching, laying, joining and backfilling. 2. Laoudis will install, at his own cost and expense, the mains and distribution lines for Angel Shores in substantial accordance with Exhibits G and H (to be approved in accordance with plans to be submitted at a later date) including all necessary engineering work, such as trenching, laying, joining and backfilling. 3. Laoudis and Cove will grant complete freedom of access to all parts of their premises during construction for the purpose of inspection by the Village. 4. The Association hereby retains the Village to act as the manager of the Water System. In furtherance of the Village's duties as manager, Laoudis and cove do hereby grant and convey to the Village an easement and right-of-way for the purpose of repairing, operating, maintaining and replacing the Water System, over the Water Supply Area and also over an area five feet on either side of all mains and distribution lines for as long as 3 the Village operates the Water System. Said easements are not exclusive. In furtherance of same, Laoudis and Cove will execute and deliver the Easement annexed hereto as Exhibit K upon receiving notice of request for same from the Village. 5. Laoudis and Cove hereby also grant and convey to the Village an easement over the length and width of all roads for the purpose of ingress and egress to the Water Supply Area and the water system or any portion thereof. 6. Laoudis and Cove will execute and deliver the deeds of dedication annexed hereto as Exhibits E and J upon receiving notice of request for same from the Village, which deeds are subject to prior offer of dedication contained in covenants and restrictions as amended. 7. The Village, repair and if necessary, as manager, will operate, maintain, replace the Water System or such portion of it as is constructed and in use (it being assumed that water will be provided to the Condominium prior to being provided to Angel Shores), and all components thereof up to the individual water meter pits. ft will also continually test the water quality and quantity to assure it meets all applicable ~equirements for drinking water and do such other things as are regularly done by the Village in operating it's own water system. The Village will pay out of sums collected by it all operating costs of the system, including paying the premium to keep the buildings insured against loss by fire or other 4 casualty, and payment of real property taxes. 8. The Village will install meters and inspect, test and repair same all at the cost and expense of the Association member, and will bill the member directly, on a quarterly basis. In the eveDt the member does not pay such charge within thirty (30) days of receipt of a bill from the Village, then the Village may send such statement to the Board of Directors of the Association which shall be responsible for payment of same. 9. The Village shall administer the system in conformity with its published rules and regulations as far as applicable. 10. Laoudls and Cove shall establish and cause to be funded a reserve fund for enhancement and repairs to the system in an amount equal to $1,000.00 for each residence serviced by the Water System. Laoudis and Cove will fund the initial $25,000.00. The Village may use up to $10,000.00 of such funds for repairs as in its sole discretion it deems necessary, and may use whatever other sums are necessary in an emergency up to the balance of said reserve fund. Any expenditures in excess of these amounts must be approved by the Board of Directors of the Association. Said reserve fund shall be deposited by the Village in an interest bearing account for the benefit of the Association. ll. The Village will charge a managerial/administration fee which will be part of the annual budget upon which the rates will be based, and will submit said budget to the Association annually for review at least three (3) months prior to any change in the budget. The budget is intended to cover all items of operation as described in this Agreement. The initial budget, as prepared by Samuel McLendon, is annexed hereto as,Exhibit F. ~ c_~har~ef~.or managerial/adminzstration~for the first year shal e ~-~ and.shall not be increased in any year by more than ten (10%) per cent over the previous year. The cost of running the system and the obligations of the Village hereunder shall commence at such time as the Association shall request the Village to commence operating the Water System, which shall be no later than the first closing. 12. The obligations of this contract on the Village shall be for a period of ten (10) years with an option for the Association to renew for an additional ten (10) year period on the same terms and conditions set forth herein, provided notice is given to the Village not more than one (1) year nor less than six (6) months prior to the expiration date of this contract. Either party may terminate this contract'upon six (6) months prio~ written notice. 13. The parties acknowledge that the entire system has or is being offered irrevocably to whatever municipality or authority is designated by the County of Suffolk. In the event the system is taken over by the Suffolk County Water Authority or the Town of Southold, or some other municipality or authority, 6 then this Agreement shall at the option of such authority or municipality cease to be effective and the deeds of dedication, easements and all other rights granted the Village, and this Agreement, shall become null and void and except for sums due and owing the Village prior to such takeover, or cancellation, and neither party shall have any further rights against the other. 14. The Village will supply water from the Water System to members of the Association only. 15. This Agreement is and shall be conditional upon Laoudis and Cove obtaining.all necessary approvals for operation of the Water System, including but not limited to the approval of the Town of Southold, Suffolk County Department of Health and the Attorney General. 16. The water supply system shall be completed substantially in accordance with all plans referred to herein, except that if the municipality, authority or other entity whose approval for construction is required, shall request changes, then the construction shall be in accordance with the standards thereby requested. 17. The Village agrees to properly secure and safeguard the Water System, as constructed, including the Water Supply Area, and to suggest additional measures to the Association which the Village considers desirous in order to protect against injury to the water supply system, including mains and distribution lines, by vandalism or other destruction, and to prohibit trespass by third parties. ? ( 18. The Village also agrees that it will cooperate with Laoudis and Cove as reasonably requested, in attempting to secure any necessary approvals of the Town of Southold and/or other governmental authorities. 19. This Agreement shall enure to the benefit of and shall bind the respective heirs, legal representatives, successors or assigns of the parties hereto except that the Village may not assign its obligations hereunder. It's an easy song to sing~ an important one to believe in...here goes: The Town Hsll Meeting I went to a Town Hall meeting and much to my delight, they had a quilt that showed the Southold of old, ...~hat a pretty sight. I went to a Town Hail meeting, not everyone was there; but we stuck it out 'til ten to ten then got the nod £rom the chair. But it's all right now, together we are bound. You see you can't please everyone but we'll fight £or the good o£ the Town. We spoke for the hearts that are breakin,, because be£ore one can even blink... there's too many ghost s~ores and raping our shores. It's time we stopped to think. I£ the Appeals Board makes the decision that says, "developers go have a ball;" I wonder how a quilt o£ asphalt will look han~mg on their wall. But it's all right now, to~ether we are bound. Murphy The Suffolk Times Respectfully submitted, April 15, 1988 Board of Appeal Members Dear Sirs, I am writing to you in connection with the proposed variance at the Cove in Southold. Having attended both meetings in connection with this proposal, I came away from the meeting April 14th feeling completely frustrated and let down. Probably due to my inexperience and ignorance of precedure it seemed to me the meeting ended abruptl~ with many in attendance feeling they could not express their concerns. Our creeks, bays soundand all bodies of water are a nations' growing problem and concern. My feeling is Corey Creek is one of the few remaining smaller but valuable bodies of water-hopefully no yet contaminated. I~.is . ~cturesque and valuable to all baymen for their zzvehoo~, for the rest of us a place to fish, clam, sail, swim with few restrictions. Having lived almost across from the Cove for many years and residing for the last ~0years a few miles from this location, it is frustrating and disturbing beyond words to think of ih6 proposal for 3 more such units so close to wet land. It is in your power to save this very valuable creek. I beg of you to deny this variance. Help save our Corey Creek before it is too late. A precedent must be establis-ed -not next week-next mont~or next year but NOW. I respectfully acknowledge the tremendous responsibility and burden you each have in reaching a decision. However, it is in your power to decide, are we to become another section of Long Island to be ravaged and destroyed ~n a developers paradise? Please help us to keep what is left of our once quiet, ~uaint Country atmospk~re~ Our existing highways are becmming a dangerous nightmare-all ready overcrowded and the influx of "Summer Visitors" has not begun. At both meetings the hardship for Mr. Fischetti, should this variance not be passed seemed to be an issue. With my limited income , it would seem, to hkve theincome that has all ready financed the existing condos is a far cry from anyone suffering finandiAll~y. I b~lieve the only issue is to Save the Wet Lands.
