Your letter of January 31, 1973, addressed to }~r. Sidney Beckwith,
Housing Sec~tior., has been referred to me for reply. As Chief of the General
Euginee~Lng b~it of the Division of En~ironment~l Health Services, all ap-
prcvals for new construction and subdivisions must be processed through my
office; therefore, the complaint you raise in yo~zr letter rightfully should
have been directed to me.
Thi s office has been ver~y aware of the ls~d development situation
thr~gh~t Suffer: Couuty and acutely, so of its development in the East end
towns. As far back as 1959, the Health Depart~.~ent imposed regulations that
r*~ndated that all new subdix~sione which were to utilize prlv~.te wells as
the sc~rce of drinking water, must have ~n individual lot size of at least
20,000 square feet. In January of 1970, our subdivision standards were re-
vised to their current level, whereby a~_l new subdivision~s ~ast have both
public water and public sewers or an individual lot size of 40,000 squ~ure
fee~.
Almost all subdi~lsions approved in the Town of Southold from 1950 to
January 1970, had 20,000 square foot lots, and aince January 1~70, they all
have lot sizes at least 40,000 square feet apiece. All this was acccmplished
despite the fact that local t~ z~ing, ~ntil September 1971, consisted of
a lot requirement of Only 12~ )00 square feet.
We have worked long and ~ard with your local Town Pla~ing Board to
assist them in getting the ne,~ "Building Zone brdinance cf the To~ of South-
old" dr~'~m up and passed by t'~e Tcwn Board. We are still wor1~ing with the
T,wn Planning Board in their . ttempt to further upzcue certain ar~as of the
town, arid my office is also w~.,king on revisicns to our su~ivision regu2a-
tions. I'm sure your T~n Fhnning Board will welcome your support as we
do and will work with you to sccomplish what I consider to be ~ ~tual goal.

As in the case of each and every subdivision that utilizes private wells
for its water supply, and septic tanks and leaching pools for its sewage dis-
posal systems, we required a pre!i~iua~- sub~&ssion of a topographic map.
Upon receipt of this map, we plotted locations of test holes and test wells
to obtain information on which to base our decision as to the type of sewage
disposal system to be utilized and the quantity and quality of fresh, water
available. This data, in the case of the Land's E~d subdivision, indicated
that the sell conditions were good and that there would be no difficulty in
installing a sewage disposal system on each lot that would meet our standards.
The test wells revealed that there was a minimum of 15 feet of fresh
water available at the site. Chemical analyses of water samples from the
test wells were satisfacto~7, with the exception of a high iron content in
the first samples. The wells were repumped and san~led, and the second
analysis frcm each well indicated a satisfactory iron content. The water
analyses results were further checked against the results obtained from
walls on lots 16 and 17 of Orient-~--the-Sea, Section one. These two lots
were recently built upon, and the water analysis reports from these wells
indicated that the water quality was excellent.

Since all the minimum requirements of the Department of Health were
mdt by the applicant subdivision, Land's End, the map was approved. We
take exception with your statement charging us with the reckless granting
of approvals to subdivisions, as it has been this Department that has set
the requirements that has lead to current t~m zcning standards, and'the
development of town ~ster Plans. It is gratifying to see gr~ps such as
the Com~ittee to Save Orient Point, becomJmg more and more involved in
Planning and en%~ironmental problems.
It is my hope that you will involve yourself in the whole town develop-
m=nt and not just limit y~rself to the Orient Point area, as it is often
easier to control the whole, rather than a piecemeal approach.
