Ball and Kimberly van Lee PROPERTY LOCATION: 39550 NYS Route 25, (Adj. to Gardiner's Bay), Orient,NY SCTM: 1000-15-8-26.8 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type Il category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated August 24, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.The LWRP Coordinator issued a recommendation dated November 29,2022.Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject, conforming, irregular-shaped, 497,455 square feet, 11.42 acre waterfront parcel located in the R-200 zoning district measures 53.82 feet and 210.42 feet along Main Road/NYS Route 25, then runs south, around "Latham Cemetery", 80.56 feet and continues west 131.20 feet and then north 82.75 feet back to the State roadway at the head of Cedar Birch Road(private 50 feet wide right of way),then crosses the intersection 51.03 feet west and runs south along the right of way, along multiple residences, each with access, 82.5 feet, 142.56 feet, 1085 feet then follows a curve R=107.32 feet and A=200 feet, then turns south 18.28 feet (creating an appendage),west 337.55 feet, south 59.09 feet,east 339.69 feet, north 81 feet and then runs east 290.47 feet and continues 447.89 feet and continues back to the State Road, 733.63 feet, runs west 50.09 feet then south 731.65 feet, 424.33 feet and 195.44 feet (creating a second appendage), then runs north 1279.54 feet back to the roadway. The parcel is improved with a two-story residence with attached porches, a detached garage,a small wood shed, a wood platform with electric service at the `tidal pond', remnants of a wood bridge leading to an island at the fresh water pond, an earthen driveway (the right of way) and a gravel driveway to the residence, as shown on the survey prepared by Stanley J. Isaksen,Jr., Licensed Land Surveyor and dated August 23, 2000. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-14 and the Building Inspector's June 15, 2022 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; at; 1) located less than the code required minimum front yard setback of 60 feet; at: 39550 NYS Route 25, (Adj.to Gardiners Bay) Orient,NY. SCTM#1000-15-8-26.8. Page 2,December 15,2022 #7714,Ball SCTM No. 1000-15-8-26.8 RELIEF REQUESTED: The applicant requests a variance for alterations and additions to an existing house, consisting of a porch expansion,a mudroom entry, and a carport with second floor living space including an en-suite bedroom with full bath, a family room and second, full bath, where the improvement will establish an 11 feet front yard setback where the code requires a minimum front yard setback of 60 feet. ADDITIONAL INFORMATION: While the survey provided illustrates a lot size of 11.42 acres, the property consists of two, uncombined/unmerged parcels: SCTM 41000-15-8-26.7, 4 acres, and#1000-15-8-26.8, 7.43 acres. The improvements and residence, subject of this application is located on lot 26.8, while the 50 feet wide private right of way, known as Cedar Birch Road, is located on lot 26.7, which encircles the subject parcel and a parcel owned by the State of New York. The residence is located well over 500 feet south of Main Road/NYS Route 25, the applicant's road front. However, the parcel is considered to have multiple front yards as a result of the right of way. Further encumbering the parcel are tidal wetlands and a freshwater pond, which require a minimum setback of 100 feet for any improvement. The existing house and barn/garage are built outside of the 100 feet wetland's setback and within the 60 feet front yard setback from the right of way. Existing improvements on the subject parcel (SCTM: 1000-15-8-26.8) are covered by the following Certificate of Occupancy: #Z-22787 dated December 14, 1993 covering a one family dwelling as applied for. #Z-26998 dated March 22, 2000 covering the construction of an agricultural building #Z-36816 dated March 24, 2014 covering alterations to an existing,unheated, accessory building No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 1,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding neighborhood is defined by Main Road/State Route 25 which is a major east/west artery in the Town of Southold and also serves the county, connecting it and points west, via ferry to Connecticut and New England. Homes in the immediate area tend to be historic in nature and built close to the roadway,many on less than code conforming lots. Open space abounds and the adjacent parcel to the east is owned by New York State as part of the Orient Beach State Park. The subject parcel is accessed via Cedar Birch Road, a private right of way, also owned by the applicant. This unimproved road allows access to approximately seven neighboring properties, each facing east towards the applicant's residence and each with perceived compliant front yards. The applicant maintains a primary front yard setback, from Main Road, their address,of over 600 feet,where a minimum of 60 feet is required by code. As a result,when paired with the 50 wide right of way,the relief sought will not be easily discernable by immediate neighbors or those traveling on busy State Route 25. 2. Town Law 12267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of the tidal wetlands and freshwater pond, the Page 3, December 15,2022 97714,Ball SCTM No. 1000-15-8-26.8 development of the subject lot is severely limited. Any expansion to the existing residence will require some form of variance relief as it is constructed within the 60 feet front yard setback from the right of way. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 82% relief from the code. However, by granting relief for a reduced front yard setback and allowing upland expansion away from sensitive wetlands, the applicant better conforms to the Town of Southold Trustees and New York State Department of Environmental Conservation requirements. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions including an expanded porch,mudroom entry,and attached car port with second floor living space while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Weisman, and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by Stanley J. Isaksen, Jr., Licensed Land Surveyor and dated August 23, 2000, and the Architectural Drawings (labeled A-10, A-20, A-30, A-40 and A-50) prepared by Frank W. Uelendahl, Registered Architect and dated August 12, 2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant is to provide the Board with copy of a Certificate of Occupancy or a valid Board of Trustees Wetland Permit for the wood platform measuring 14.9 feet by 16.6 feet, located at the tidal pond, prior to the issuance of a Certificate of Occupancy for the alterations and additions granted herein. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving Page 4,December 15,2022 #7714,Ball SCTM No. 1000-15-8-26.8 nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: A VY floor addition for an additional bedroom is not feasible based on the existing layout of the house which has a wraparound covered porch on the east and north side and a septic system located close by to the north of the dwelling.The proposed 999 SF addition on the 21d floor above the existing driveway is the only sensible option to expand the dwelling for a much desired additional bedroom suite and home office. The Building Department decided that a setback variance of 11 ft should be requested because it considers the private earth drive,the 50'right of way,a separate lot as per SC Tax Map. It should be noted that the applicants own this lot as well(SCTM#1000-15-08-26.7).As per the property card the two parcels were combined in 1983 which would establish a 11'+50'setback to the proposed addition,thus rendering the disapproval void. (3) The amount of relief requested is not substantial because: Should both parcels in effect be considered one lot a variance would not be needed.According to the Buidling Department's call the requested relief could be considered substantial because Chapter 280 of the zoning code does not offer a bulk schedule for a lot this size. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The proposed 2nd floor addition above the driveway is approximately 35 ft away from the dirt road as scaled from the survey.There are no neighboring homes directly opposite the proposed addition located west of the drive.The proposed action will not produce a negative impact on the physical or environmental conditions in the neighborhood.
