SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, rectangular-shaped, 15,625 square feet, .359 acre parcel located in the R-40 zoning district measures 125 feet along Bay Haven Lane, then runs northwest 125 feet along a residentially developed lot to the south,then runs northeast 125 feet along an undeveloped residential lot to the west and returns 125 feet to the roadway along a second residentially developed lot to the east. The subject parcel is improved with a 1-story, wood frame house with front entry landing and steps, attached garage, a raised deck of the rear of the residence and a wooden platform at grade off the rear of the garage, stockade privacy fencing and an asphalt driveway as shown on the survey prepared by Michael W. Minto, Licensed Professional Land Surveyor, and dated February 26, 2021. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's July 21, 2022,Notice of Disapproval based on an application for a permit to construct a screened patio addition attached to a single-family dwelling, at; 1) located less than the code required minimum rear yard setback of 35 feet; located at: 450 Bay Haven Lane, Southold,NY. SCTM No. 1000-88-4-23. RELIEF REQUESTED: The applicant requests a variance to construct a screened-in covered porch addition to the rear of the residential structure, measuring 13 feet by 15 feet with an overall height of 15.6 feet, with a rear yard setback of 30.6 feet where 35 feet is required by the code. ADDITIONAL INFORMATION: Improvements on the subject parcel are covered by the following Certificates of Occupancy: Z-19865 dated April 24, 1991 covering a new single family residence with attached garage and deck Z-42011 dated May 7, 2021 covering an "as built" deck addition No member of the public or an immediate neighbor spoke in favor of or against this application. Page 2,December 15,2022 #7709,Carballal SCTM No. 1000-88-4-23 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 1, 2022, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(I). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Bay Haven beach community is an older subdivision consisting of less than code conforming lots aligned on a grid with a shared Peconic Bay beach parcel. Area homes were developed over the past half-century with many properties, especially the waterfront lots, redeveloped or substantially altered in recent years. The addition of a screened in porch to the rear of the existing residence is not visible from the roadway,the reduced rear yard setback is not visually discernable,and the requested improvement is in keeping with many other homes in the immediate vicinity that have covered and or screened in porches, both in Bay Haven, and the Town of Southold in general. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of the homes initial siting and its deep"L" floor plan design, it is not possible to add any functional extension to the rear of the residence without variance relief. Alternatively, while the applicant could place the screened in porch along the side of the house it would not allow useable access from the rear door as proposed. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 12.5%relief from the code.However,the existing home maintains both a front and rear yard setback of 35 feet,and the garage area is pushed farther back than is commonly found in the neighborhood, establishing an increased front yard and offsetting the relief sought. 4. Town Law 4267-b(3)(b)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a screened in porch measuring 13 feet by 15 feet with an overall height of 15.6 feet while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried,to GRANT the variance as applied for, and shown on the Site Plan and Architectural Drawings (labeled SD-1, SD-2, SD-3, SD-4)prepared by Anthony M. Portillo, Registered Architect, and dated June 16, 2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant is to provide the Board with copy of an existing Certificate of Occupancy for the installation of new windows and central air conditioning to the subject house or apply for and receive same prior to the issuance of the Certificate of Occupancy on the applied for improvement. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appealsfailure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on.the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B)of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null'and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted.
