Dear Mr. Geldeman:
The following action was taken by t},~ Board of Town Trustees during
their regular meeting held on July 27, 1987 regarding the above matter.
WHEREAS, the Board members have personally wewed and are fam~har w~th
the premises ~n question and the surrounding area, and
WHEREAS, the Board considered all the documentation subnntted concermng
th~s request, and
WHEREAS, the Board made the following findings of fact:
1. By th~s request appellant requests permission to construct a 25' x 25~
accessory bmldmg for storage purposes.
2. The property is located on Osprey Nest Road, Greenport.
3. The project w~ll not affect the health, safety or general welfare of
the people of the Town.
NOW, THEREFORE BE IT
RESOLVED that John H. Geldeman on behalf of W~lhelm Franken Be and Hereby
~s Granted a Waiver of the Wetland Ordinance as aforementioned and all in accordance
with the apphcat~on and plan subrmtted on July 9, 1987.

WHEREAS, a public hearing was held and concluded on July 16,
1957 ~n the Matter of the Application of WILHELM FRANKEN under
Appeal No. 3639, and
WHEREAS, at sa~d hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application, and
WHEREAS, the Board Members have personally viewed and
familiar with the premises tn question~ its present zoning,
and the surrounding areas; and
are
WHEREAS, the Board made the following findings oF fact:
1. By this application, appellant requests Variances from
the Provisions of the Zoning Code for permission to locate a
25' x 25' accessory (storage) building, at a point not closer
than 15 feet from the front property line along Osprey Nest
Road and not less than 56 feet from the bulkhead at ~ts closest
point, all as shown on sketched plan dated April 28, 1987,
prepared by J.H. Geideman.
2. The premises ~n quest]on contains a total lot area of
29,200± sq. ft., ]s referred to on the Cleaves Point Properties
September 10, 1957 Map No. 2752 as Lots 14, 15 and a strip of 25,
and is improved with a single-family dwelling set back 35 feet
at Its closest point to the front property line and 32 feet from
the nearest bulkhead. The sub3ect premises is more particularly
known on the Suffolk County Tax Maps as District 1000, Section
35, Block 6, Lot 24.

3. Article XI, Section 100-119.2 requires all buildings
and structures to be set back not less than seventy-five (75)
feet from a tidal water body, t~dal wetland edge, or freshwater
wetland.
4. Article III, Section 100-32 requires accessory bu~ld-
1rigs to be located only in the rearyard area.
5. It is the opinion of the BoarJ that the construction
of an accessory storage bulld~ng in any yard area upon this
parcel will require variances, and the location chosen by th~s
application is the most feasible, provided it is placed as
applied.
6. It is also the opinion of the Board that:
(a) appellants request is not unreasonable and the
circumstances of the property lend to the d~fflcult~es;
safety,
town;
(b) the variance will not in turn be adverse to the
health, welfare, comfort, convenience or order of the
(c) the relief requested ~s not substantial in
relation to the requirements,
(d) there is no other method feasible for
appellant to pursue other than a variance,
(e) there w~ll be no detriment to adjoining
properties;
(f) in view of all the above factors, the ~nterests
