Findings: The Board of Trustees DENIES the application as submitted. The project does not meet the requirements for issuance of an Administrative Permit as set forth in Chapter 275 of the Southold Town Code. The placement of sand does not meet the intent of the 25' no mow buffer which was to remain vegetated. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. Basically our understanding of permit 5942 for this property is that we can mow the lawn up to the top of the steps of the dock(beyond which is a no mowing zone). As requested,the attached shows before and after pictures, (with the specific area in question circled in red),of our backyard. To summarize,we purchased the house earlier this year, and later in the summer removed some vegetation and sanded the area circled in red within these pictures to prevent growth of taller grass/bushes in the area, due to safety concerns. (Younger members of my family and friends who walked in the grass developed lyme disease or poison ivy while playing in the area.) However,we didn't realize this required permitting as our neighbor's lawn appears to be sodded in the same area where we removed the vegetation, (see the third pic),and,we mistakenly thought permitting pertained to just tree removal. Our apologies for this oversight. I am hoping you can help advise as to what we need to do at this point,ahead of our Jan 4th court date to satisfy the proper documentation/permitting/other requirements,and we will promptly comply. A Wetlands Permit(5942) issued in 2004 prohibited mowing within 20' of the wetland except for the path. 2. In 2005 a 25' wide no-mow buffer was included within a Board resolution. 3. The placement of sand in the area does not meet the intent of the 25' no-mow buffer which was to remain vegetated and measured from the wetland boundary seaward to protect the water quality of Goose Creek. Pursuant to Chapter,268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
