It is a retail building in an HB zone with an accessory apartment. The apartment is already more than 50% the size of the retail space. We are proposing to increase the size of the accessory apartment further, which has generated this application. I had a conference call with Mike Verity and the planning board last year, and it was decided that we could apply to the ZBA for the area variances we needed at the same time as the Planning Board. As things went, we have already received our zoning variances for the project. Enclosed is the following: 1. Site Plan Application 2. Check payable to Town of Southold - $500 + $38.30 (10% of 383 sq. ft. addition) 3. Notice of Disapproval from Building Department 4. Copy of the ZBA decision 5. Applicant's Affidavit 6. The existing roof deck at the rear of the building will be reduced in size and rebuilt but will maintain the existing side and rear yard setbacks. There is a shortage of affordable housing on Fishers Island. The accessory apartment is being improved to make a viable dwelling unit for a year-round resident. ONS —' ACTION: Fj-ZjQI NG$..0 `—ACl/A S j— Olk BOARD AC-- The Zoning Board of Appeals held a public hearing on this application on December 7,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1, Town Law §267-b(3)(W(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is a commercial property located in the only stretch of commercial buildings on Fishers Island. An apartment already exists and the applicant wishes to expand the unit for rental to a year-round resident at an affordable price. The architectural proposal in in keeping with the took of this commercial area. 2. Town Law §267-b(3)(Wj2 . The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The variance process is necessary due to the nonconforming existing setbacks. The parcel is quite small for its zone, making setback conformity impossible. 3. Town Law §267-h(3)Lb)(3)j The variances granted herein are mathematically substantial, representing the following relief from the code: 1) Code requires 15 ft. front yard setback;they have a proposed 10 ft. front yard setback=3 3.3 3% 2) Code requires minimum side yard setback of 10 ft.;they propose 1.9 ft. setback=81% 3) Code requires combined side yard setback of 25 ft.;they propose 3.5 ft. setback=86% 4) Code requires 40% lot coverage;they propose 49.6%=24% 5) The apartment shall not comprise more than 50% of the principal building=the proposed apartment will be 70% of the building=40% However, the building is more than 100 years old and even with the expansion of the existing second floor apartment, the building's setbacks, footprint or height will not change. 4. Town Law §267-1y(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the'rown's Storm Water Management Code. The existing sanitary system is relatively new and the number of bedrooms is proposed to be reduced so the existing sanitary is code conforming. p f Page 3,December 7,2023 #7856,411 Equestrian Avenue SCTM No. 1000-9-4-3 5. Town Law 267-b 3 'b . The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. . 6. Town Ldaww`267-b Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an expanded rebuilt apartment while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. -SCQ:, Tf0N OF MIS BOAR._D: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Acampora, seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variances as applied for, and shown on the survey map prepared by Craig P.
