Loreto 795 Glen Court Cutchogue, NV 1193§ Re: Appeal No. 3574 (Variances) Dear Doctor Loreto: In researching the prior variances and building permits concerning your properties, we find that there was a conditional variance approved for a lO' by lO' tool shed on the dwelling parcel (Lot #2) on July 30, 1980, for which a building permit and Certificate of Occupancy were.issued Apr,it 5, 1985 (BP #10807Z, C.O. #Z13329). The restrictions of that variance were for a maximum 10' by 10' gazebo-type storage building to the west of the dwelling, not closer than five feet to the west side property line. Also found was a Certificate of Occupancy #Z13326 dated April 5, 1985 for a gazebo accessory structure on the dwelling parcel with a minimum setback of three feet from the east property line. Town records show that you are being assessed for a 14' by 14' gazebo-type structure also on the dwelling parcel. The survey submitted by you shows no accessory buildings on the dwelling parcel, but indicates a gazebo-type structure on the vacant parcel (Lot #3). Inasmuch as no one was present at the hearing to answer questions, we must request a clarification of the structures, as exi,st, and whether the Certificates of Occupancy and Building Permits a~re for the structure(s on the dwelling parcel. No record can be found for a building permit on the vaca.nt parcel's gazebo as shown Page 2 - Appeal No. 3574 December 19, 1986 on your sketched survey. Please submit a Sketch or survey of each of the two parcels, and the accessory buildings referred above, and the proposed (total three accessory structures, two on the dwelling parcel, one on the vacant or the dwelling which you propose}. WHEREAS, a public hearing was held and concluded on 1986 in the Matter of the Application of DR. JOHN LORETO No. 3574; and November 20, under Appeal WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the board members have personally viewed and are familiar with the premises in question; its present zoning, and the surrounding areas; and WHEREAS, the board made the following findings of fact: 1. This is an application for Variances from the Provisions of the Zoning Code as follows: (a) Article XI, Section 100-119.2(B) to construct with an insufficient setback at 30 feet from the edge along the top of bluff along the Long Island Sound, (b) Article III, Sections 100-30 and 100-32 to construct for use as storage incidental and accessory to the existing dwelling adjacent to the west of this parcel. The construction proposed is a 10' by 14' wood-design storage shed. 2. The premises in question is a substandard parcel known and referred to as Lot No. 3, Map of "Vista Bluff" filed March 15, 1968, at Cutchogue, and is shown according to Building-Department and Assessors records as vacant land. LORETO Decision Rendered January 8, 1987 applicant's dwelling parcel), although town records how that a building permit and certificate of occupancy was l~sued under Permit #11239 and CO #13326 during 1981 for a gazebolon the dwelling parcel a minimum of three feet west of the ~asterly property line. 3. ~he premises upon which the requested lO' by 14' accessory shed is to be located contains a lot area of approximately 25,000 sq. ft. and lot width of 100 feet. The buildable area (as shown by the sketched survey prepared December 20, 1977 byiFrank H. Atkinson, L.S.) is a size of approximately 100 feet Wide by 120 feet deep ~to the top of bluff], or 12,000± sq. ft. :~ It is the position of the Board to locate the shed a distahce 40 feet from the top of bluff and approximately 70 {eetlfrom the front property line along Glen Court. This~.location~ ~would allow for proper placement of a new dwelling in the future in accordance with the required setbacks of the zonih9 code (without additional relief). 4. Article XI, Section 100-119.2, subparagraph~A[1] requires all buildings proposed on lots adjacent to the ~ong lis]and S~und to be set back not less than one-hundred (100) feet ~rom the top of the bluff, or bank. The board finds that compliance with this lO0-ft, setback restriction would be placing same. ini the front yard very close to the road (front) property line. In considering this appeal, the board also findls and determines: (a) although the percentage of relief reques%ed is substantial in relation to the requirements, the idifficulty cannot be obviated by some method feasible for appel!lan.t to pursue, other than a variance; (b) the.placemen~ o:f the 10' by 14' accessory storage building at ~a. point noti_closer than 40 feet to the top of the bluff and a distance :of 70+ feet from the front property line is not unreasonabl'e and will not be detrimental to adjoining properties, or changle the character of the district; ic) the circumstances 0!:~ the property are unique; (d) the practical difficultiesI are suffi- cient to warrant a conditional.granting of .this appliication~.
