Alfred Hull, wi~h whom you entered in~o an Agreement on or about September 1, 1986 ~o construct a dwelling on premises owned by them a~ 3630 Soundview Drive, Peconic, New York. Pursuant to said agreement, the owners have made cash payments ~o you for the full contract price con~emp!ated in the terms of said agreement, to witl $139,000.00. In addition, Mr. and Mrs. Hull have paid to you in cash some $16,000.00 over and above the contract price for "extras" not contemplated by said Agre~men~ or any rider or modification thereof. You are hereby put on no~ice tha~ you have defaulted in your performance of your obligations under said agreement, and ~hat, because of your continued default in spite of the owners' repea~ed requests that you complete performance, said owners hereby declare you in breach of said Agreement and elect ~o terminate said Agreement pursuant to their rights thereunder. Your non-performance of the following te,.,--n~ and conflitions of applicable provisions of said Agreemen~ is as iollows: (1) You have neglected to fully perform, withou~ legal ground or justification, the entire work e~braced in said Agree:nent on or before February 27, 1988, twelve (12) months following the issuance of a building permit by the Town of Sou~hold, as required by Article 2 of said Agreement, in tha~ you have failed and refused to deliver a final certificate of occupancy covering the dwelling erected pursuan~ ~o said agreement; (2) You have neglected and failed to pay, ~o %he presenh knowledge of the owners, at least the plumbing and electrical subcontractors who performed work on the premises at your insistence and request, despite payment in full of the purchase price by ~he owners pursuant ~o Hiroshi Harrison Page Two February 9, ~989 Park the schedule of payments se~ forth in Article 28 of said Agreement, and refused to provide to the owners proof of pa}~en~ of all labor and material costs, in spite of the owner's repeated requests, as per Paragraph 1 of the Second Rider to said Agreement; and (3) You have, without just csuse or provocation, abandoned [,erfcrmance of the work contemplated by said Agreement in that you have neglected and refused to: (a) Procure a final survey of the subject premises for subm~ssion to the Suffolk County Department of Health Services and to the Town of Soathold Building Department; (b) Procure a cesspool certificate from your cesspool s~bcontractor and file same with the said Department of Health Services; (c) Obtain the final approval of the said Department of ~ealth Services of the construction of ~he dwelling; (d) Procure a solder certificate from your plumbing s~bcontractor and file same with the Town of Sou~ho!d Building Depart~ent; (e) Obtain a final certificate of occupancy co~:cerning the s~.ject dwelling from ~he Town of Southold ~uildin, Department; and (f) Remedy , eficiencies in your performance of the install tion of the patio door and ceramic tiles in two (2 bathrooms in said dwelling.
