You have askgd me to update the above captioned appraisal report to the
extent that the ~ut building, mdentlfled as Guest Cottage, contrmbuted to
value.
Due to the a~sence in the market of any sales data on which to base the
value of the gues~ cottage in a classic appraisal format, the approach was
based on depreciated replacement cost and equated to the value of the
residence. An ~ddmtlonal adjustment of $10,'000. was add¢~ based on the
greater appeal of a legal, non-conforming detached guest cottage. Thls
rationale continues to be a valid analysis mn the current market with only a
positive upward ~d3ustment required for overall teal estate appreciation
since the date oflthe appraisal.
The sub3ect lsa waterfront property. Market data supports an annual
appreciation fact6r of 20% for waterfront properties durmng-the time permed
from April 1986 ~o the date of this letter. The updated value of the guest
cottage is computed as follows:

Dear Mr. Davis;
We have an aplplicatlon pending for approval of access over
a private right-of,-way located approximately 450 feet west of
Aldrich Lane along, the north side of Sound Avenue at Matt~tuck
and extending in al northerly direction (partly over lands owned
by C. Simmons and partly over lands owned by Harbes, who
purchased from Entpnmann). The lot in question to which
access ~s requeste~ is owned by Michael Racz and Gall Dess]moz,
and is improved w~th an one-story house, accessory garage and
accessory cabin ~tructure as shown on the attached photocopy.

Young & Young, licensed surveyors in Riverhead have advised
our office that it: is their belief that the right-of-way Is
not a descriptive Kight-of-way but is a traveled right-of-way
as has existed ovey the years. It Is also understood that the
280-a being requested in this application is for access to
this residence, anD that updated reviews will have to be
made by the town a~ to appropriate 280-a for other newly
built homes in the future.

WHEREAS, publ'lc hearings were held on December 12, 1985 and then
concluded on February 6, 1986, in the Matter of the Application of
GAIL DESSIMOZ ANDiMICHAEL RACZ under Appeal No. 3431, and
WHEREAS, the board has considered all testimony and documentation
entered into the record concerning this application, and it ]s noted
that there has been public opposition as noted ~n the verbatim trans-
cription of the h~arlngs in this matter; and
WHEREAS, the Iboard members have personally viewed and are fam]lldr
with the premises'in question, its existing structures, present zoning
(A-80 Residential 'and Agricultural), and the surrounding area, and
WHEREAS, the iboard made the following findings of fact.
I. The prope, rty ~n question is located along a private right-
of-way known as Private Road #10, or Halleck's Lane, Mattltuck,
extending approximately 4098 feet north of Sound Avenue and thence
~n a westerly direction 153 feet.
2. The subject premises is identified on the Suffolk County
Tax Maps as Distr%ct 1000, Section 112, Block 1, Lot 4, contains an
area of 1.940± ac~es and lot width of 124± feet, and ]s improved
with the following structures as shown by architectural plan dated
January 2, 1986 p<epared by Peix & Crawford Architecture (a)
single-family, on~-story frame dwelling; (b) 12' by 22' garage

located in the f~ontyard area; and (c) the subject 9' by 16'
structure located in the rearyard area within 45' of the bluff .
area along the Long Island Sound.
3. By this. application, appellants request permission to
enlarge~ and renovate the existing 9' by 16' accessory structure
for sleeping quarters without kitchen or cooking facilities, and
~ccessory and ~ncidental to the ex~st~ng s~ngle-fam~ly use of th~
premises and not'to be operated for gain or rental/bus,ness
purposes.
4. Appellants propose an enlargement of the subject
accessory '~cabinI' structure of 250%, or 500 square feet,
for a total square footage of 662.75 feet, at a height not
to exceed 16' (e~clusive of roof construction), as shown by
archltectural plan dated January 2, 1986 received January 6, 1986,
to be located within 45 feet of the existing bluff area along the
Long Island Sound.
5. The proposed f~rst floor plan consists of a s~ze of
20' by 20' for a bedroom, closet, alcove, bath, storage, entry
porch areas, and:enclosed porch project~ng 7'9" by ll' w~de along
the northerly side; the proposed second floor plan consists
of a bedroom, bath, closet, stairway, and open deck area.
6. For the record, ~t is noted that the structure ~n question
is not on a permanent foundation and is supported by concrete
blocks at the cokners, and ~s shown on the Town's pFoperty assess-
ment card as "O.B.", or outbuilding.
7. Although there ~s a Certificate of Occupancy for Noncon-
forming Premises' dated October ll' 1983 udder No. Z-11990, an
affidavit has been submitted for the record from an adjoining
property owner s~ating that the "cabin structure" was moved to
~ts present location some 15 years ago, and later bathroom
facilities were Nns~alled for swimmers. It may be questionable
at th~s point ~n t~me due to the poor condition of this structure
as to whether the use of same was continuously used and not
abandoned for a two-year per~od of t~me.
8. For the record, it ~s also noted that a review and
report has been ~ade by the U.S. Department of Agriculture,
So}l Conservat~op Service dated December 23, 1985 ~ndtcatlng
that erosion of %he toe o~ the bluff slope could cause the un,Ire
bluff face to slide and erode away, and the building could be in
danger of fallin ~nto the Long Island Sound (as ~s occurring at
premises to the Cest).
9. It is ~e opinion of th~s board that the practical
d~fficulties dem)nstrated by the appellants are not sufficient
to warrant the g-anting of the variances requested under the
circumstances.
In considering th~s appeal, the board has determined:
(a) that the relief requested is substantial in relation to
the zoning requirements, being 250% of a variance from the
provisions of SeCtion 100-118, and more than 100% of a variance
from the provisions of Section 100-119.2, (b) that th~s
proposal is not ~ons~stent w~th those generally ex~st~ng ~n
the neighborhood' and there w~ll be a substantial change in the

character of this distr~ct, (c) that the practical difficul-
ties demonstrated are not sufficient to warrant a granting of
the relief requested; (d) that the public health, welfare,
safety, order, convenience of the town will not be served by
granting the relief requested; (e) that there ~s another method
feasible,for appellants to pursue other than a variance to
provide additional sleeping quarters, within the main building,
(f) that the spent of the zoning ordinance would not be served
by granting the relief as applied under Appeal No. 3431, (g)
that the safety o~ the occupants of the structure in question
w~ll be endangered ~n the event of a change in the toe of the
bluff or substant)al erosion; (h) that the interests of justice
would best be served by denying the variances in their entirety

RESOLVED, that the relief requested under Appeal No. 3431

r~ght-of-way known as Halleck Lane and referred to as Private Road
#10, extending oflf the north side of Sound Avenue, Mattltuck, New
York (over and alpng lands of Charles S~mmons and Edward Harbes).
County Tax Map Parcels No. 1000-112-1-7 & 8, and to Parcel No.
1000-112-1-4. '
WHEREAS, a p~bl~c hearing was held and concluded on August 14,
1986 in the Matte~ of the Application of GAIL DESSIMOZ and MICHAEL
RACZ; and
WHEREAS, at ~a]d hearing all those who desired to be heard were
heard and their testimony recorded; and
WHEREAS, thelboard has carefully considered all testimony and
documentation submitted concerning th~s application; and
WHEREAS, thelbeard members have personally v~ewed and are
familiar with the.premises in question, its present zoning, and
the surrounding a~eas; and
WHEREAS, thelboard made the following findings of fact:
1. The property to which appellants are requesting New
York Town Law, SeCtion 280-a approval, is located ]n the "A-80"
Residential and Agricultural Zoning District as more particularly
shown on s~te plan dated November l, 1985, prepared by Pe]x and
Crawford Architecture, contains a total lot area of 1.940± acres
and lot width of 124± feet, and ]s ~mproved with the following
structures: (a) single-family, one-story frame dwelling;
(b) 12' by 22' garage located ]n the frontyard area; and
(c) a 9' by 16' accessory building, as referred ~n Certificate
of Nonconforming ~remises No. Zl1990 dated October ll, 1983
(Carel DeLeeux and. Edward Urbanello). This parcel is identified
on the Suffolk Coulnty Tax Maps as D~str~ct 1000, Section ll2,
Block 1, Lot 4, anld ]s referred to as 4255 Private Road No. 10
(Halleck Lane), Malttituck.

Accordingly., on motion by Mr. Goehr~nger, seconded by
Mr. Sawicki, it was
RESOLVED, that a variance pursuant to New York Town
Law, Section 28~-a, for temporary approval of access, BE
AND HEREBY IS APPROVED under Appeal No. 3433 concerning-
premises of GAI~ DESSIMOZ AND MICHAEL RACZ, SUBJECT TO THE
FOLLOWING CONDITIONS:
1. That this 280-a approval is limited requiring minor
~mprovements to the right-of-way in order to allow proper
issuance of a bu~ld~ng permit for the renovation/repair of
existing accessory (cabin) structure. No other building
permits shall be ~ssu~d for this property or other
properties having this same legal access route until
final 280-a has been filed and re-considered.
2. Improvements, w~th~n the legal per~meter of the
right-of-way fo~ a minimum width of ten (10) feet,
without d~sturb~nce to nearby trees along the right-of-ways
as follows:
(a) commencing approximately 2200 feet north of Sound
Avenue, regrade with bankrun having a 20% stone content; and
(b) filling all potholes and depressions.
3. ContinuOus maintenance of r~ght-of-way for safe and
sufficient access by vehicles.
4. Any other building permits, new subdivisions, set-offs,
or construction.on this or other premises along this r~ght-
of-way shall al~o be subject to additional application for
New York Town L~w, Section 280-a, updated access approval.
