APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple resiRences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
Vpre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

SUBJECT: Your Inquiry Dated June 24, 1988
Relocation of Historic Residential Structure
This letter is in response to your inquiry received Monday
concerning the location of a historical building on a
parcel of land identified on the Suffolk County Tax Maps
as District t000, Section 25, Block 03, Lot 12.1, fronting
along three streets known as Bay Avenue (or Village Lane),
Fletcher Street, and Vincent Street, in the Hamlet of Orient.
The parcel is presently zoned B-1 General Business; 'however,
the proposed Master Plan Maps show the premises to be
re-zoned to R-40.
The premises as shown on the February 17, 1988 survey prepared
by John T. Metzger depicts the following nonconformities:
1. Main 2-story frame building: (a) nonconforming frontyard
setback (100-71); (b) nonconforming single-family residential
use in a B-1 Zone [100-70]. Additional information will be
necessary in the initial process to determine same.
2. Two-story frame structure: (a) nonconforming single-family
residential use in a B-1 Zone [100-70]. Additional information
will be necessary in the initial process to determine same.

3. Frame shed accessory to the existing residential use (lO0-70C).
It will be necessary for the property owner to apply for the
appropriate building permits which must include all the uses of
the premises proposed (stating those uses to be used in conjunc-
tion with the subject building/use).
If the historic building is to be used as a principal residential
use, whether it be the present B-1 Zone or the proposed R-40
Zone, any increase in density (over the permitted single principal
use, whether it be business or dwelling use) must be approved by
the Board of Appeals. The Zone Districts B-1 and R-40 would not
permit an increased nonconforming use or inc?eased density without
appropriate Z.B.A. application and reviews. As you know, the
current B-1 provisions also require site-plan approval by the
Planning Board under 100-70 for such use.
Alternatively, if the historic building is to be used as an
accessory building incidental to the nonconforming residential
use of the premises, the building should copform to those set-
backs for a principal building in this B-1 Zone under the Bulk
Schedule. It does not appear that a "use variance" c6bld'be applied.
You should note for your records that under Building Permit #16733Z
issued February 10, 1988, the application reflects that the
existing use and occupancy of the premises is "one-family dwelling."
The building permit and Certificate of Occupancy #Z16646 dated
February ll, 1988, states "Accessory~st~ucture, rear yard, out
~of-.s~ction Of'the ."BAY HOUS--~,'"~ not for ~' r~-2-~ fr. hsd.'"
which was depi'cted on the subsequent survey of February 17, 1988.
Before any determinations are made, it is strongly suggested that
the history of prior actions or reviews by the Planning Board
be researched and submitted siqce there may have been other
site-plan reviews or subdivision prior to 1983 affecting this
land.

Upon my inspection of the "Accessory Structure" located
at the rear of "Bay House" 1995 Viilage Lane, Orient, N.Y., I
found the following work completed.
I. New cement block pilings to replace cedar posts. Some
of the pilings are eemented together while others are
not. There were also some new floor joists installed.
2. New plywood installed on first floor.
3. A new porch constructed on the front of the structure.
4. Double hung windows throughout.
5. The entire structure, including the roof, covered with
cedar shakes.
