If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address and t~lephone noted below° B. A copy of this permit or approval and supplementary conditions shall be available at the project site whenever authorized work is in progress. C. The permit sign enclosed with the permit or a copy of letter of approval shall be protected from the weather and posted in a conspiciuus location at the work site until completion of a~thorized work. At least 48 hours prior to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form shall also be completed and returned, E. For projects involving activities to be accomplished over a period or more than one year, the permittee shall notify the Regional Permit Administrator in %rriting at least 48 hours to the commencement of resumption of work each year. ?. If project design modifications take place after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require sub- mission of a new application for permit. G. All necessary precautions shall be taken to preclude comtamination of any wetlands or wate~ay by suspended solids, sedime~t~ fuels, solvents. lubrica:ts, epoxy coatings, paints, concrete, leachers or any other environmentally deleterious materials associated with the project work. By this application, appellant requests ~ Variance from the Provisions of Article XI, Section 100-119.2(B) for permission to construct open, wooden deck construction around the existing dwelling structure resulting in an insufficient setback from the existing timber bulkhead at 36 feet and at 30 feet from the stairway construction (at its closest point). 2. The premises in question is located along the northerly side of a private road referred to as Takaposha Road (or Private Road #15), which extends from a point at the south side of Main Bayview Road in varied south and southeasterly directions, to the subject premises, which is identified on the Suffolk County Tax Maps as District 1000, Section 87, Block 6, Lot 10. 3. The subject premises is improved with a single-family, two-story frame dwelling set back 24 feet from the front property line along the private road and 48 feet from the timber bulkhead (along Peconic Bay). 4. Article XI, Section 100-119.2, subsection (B) of the Zoning Code requires all buildings and structures to be set back not less than seventy-five (75) feet from a tidal water body, tidal wetland edge, or freshwater wetland, whichever is the closer distance. The percentage of relief requested in relation to the ~xisting established setback from the bulkh&ad is 12 feet, or 25%. 6. The total percentage of lot coverage is less than 20%,land more specifically 18% (see letter of amendment received July 24, i1987). 7. For the record, it is noted: (a) that the subject right-of-way has been the subject of a prior application, under No. 1223 granted on January 2, 1969, (G. Campbell), with the condition(s) that certain improvements be placed (for the entirelright-of-way extending back to Main Bayvisw Road); ': : (b) that premises'to the north, now or formerly of Wagner [1000-87-06-04] and.ofHarford [1000-87-06-2] have received conditional variances as noted therein for similar relief; . (e) that by Permit No. 10-87-0828, a conditional approval was rendered by the N.Y.S. Department of Environmental Conservation for this project; and : (d) that a conditional waiver was rendered by the S~uthoid Town Trustees for this project on February 26, 1987. 8. In passing upon this application, the Board has consid&red all technical evaluations, all relevant factors, all standards necessary for area variances of this nature, and finds and determines that: (a) the relief requested is not substantial, being A va£iance ~f 25% from the existing setback; ~. (b) the project as proposed will-not~ be adverse to ~he safety, health, welfare, comfort, convenience or order of the town; (c) the circumstances are not personal in nature anH are directly~ related to the property size, etc.; ~ ~ (d) there is no other method feasible fo~ appellants to pursu~ other than a variance; ~.
