Instructions
A. This application must be filled in typewriter O R ink, and submitted m ~ to the Building Inspec-
tor with the following; for new buildings or new use:
1. Final survey of property with accurate .location of all buildings, property lines, streets, and unusual
natural or topographic featu res.
2.Final approval of Health Dept. of water supply and sewerage disposal--(S-9 form or equal).
3.Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5.Submit Planning Board approval of completed site plan requirements where applicable.
B. For existing buildings (prior to April 1957), Non-conforming uses, or buildings and "pre~existing"
land uses:
1. Accurate survey of p:Coperty showing all property lines, streets, buildings and unusual natural or
topographic features.
2.Sworn statement of owner or previous owner as to use, occupancy and condition of buildings.

Re: Outbuilding construction
Dear Mr. Esslimger:
The following action was taken by the Board of Trustees during
their regular meeting held on November 25, 1986 regarding your request
for a Waiver of the Wetland Ordinance in regard to the above captioned
matter.
WHEREAS, the Board has carefully considered all of the documentation submitted
concerning this request, and
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area and
WHEREAS, all construction is behind a bulkhead,
NOW, THEREFORE BE IT
RESOLVED that Mr. Arthur C. Es~linger Be and Hereby is Granted a Waiver of the
Wetland Ordinance for a permit to place an 8' x 10' outbuilding for storage of
a boat and garden equipment 25' landward of the existing bulkhead on property
located at 1515 Arshamomaque Ave., Southold, subject to the attached conditions.
Please note that this approval should not be considered a determination
made for any other department or agency which may also have an application pending
for the same or similar project.

Roof run off shall be discharged into dry wells.
Driveways and parking areas within 75' of the wetlands shall be
of porous construction. Blacktop shall not be used on this site.
Care shall be taken so as Go preclude the entry of any construction
material into adjacent waters. ·
Immediately following construction, all areas of exposed soil shall
be properly protected with suitable erosion control devices/and or
vegetated to prevent entry of eroded soil into nearby waters.

a. This application must be completely filled in by typewriter or in ink and submitted to the Building Inspector, with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
~ b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-
cation.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issued a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

WHEREAS, a public hearing was held and concluded on December ll,
1986 in the Mat~r.gf~the Ap~lic~tio~ of ARTHUR ESSLINGER under Appeal
No. 3578; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimo~ny_~corded; and
WHEREAS, ~the board has ~arefully considered all testimony and
documentation submitted concerni.ng ~this application; and
WHEREAS, the board members have person"ally viewed and are
familiar with the premises in questioD, its present zoning, and
the surrounding areas; and
WHEREAS, the board made the following findings of fact:
1. By this application, appellant~requests a Variance from
the Provisions of Article XI, Section lO0-!lg.2(B) to construct
an 8' by 10' accessory storage building a distance not closer
than 25 feet from the existing bulkhead along Petty's Pond and
not closer than three feet from the south (side) property line.
2. The premises in question is located along the northeast
(east) side of Arshamomaque Avenue, Southold, referred to as
Lot #2l on the Map of Beixedon Estates, and is designated on
the Suffolk County Tax Maps as Distrld% 1000, Section 66, Block
3, Lot 11.
3. ' The Subject premises is improved with a one-story,
one-family 40' by 24' dwelling structure.

4. It is noted for the record that a Waiver has been issued
by the Southold Board of Town Trustees dated Novemb6r 28, 1986
for this proposed construction not closer than 25 f~et from
the existing bulkhead. ~
5. I.t is also noted that~the sloping of the p~operty
restricts the area for a feasible placement of the building,
and the Board agrees with the reasoning of the appl!cant.
In considering this application, the board als6 finds and
determines~: (a) that the va'ri~nce reqQested, is substantial in
relation to the requirements.,~'"being a.varianCe of 66%, except
however that the accessory shed. is ~andward Of an e~isting
structure; (b) there wil~l be no in.crease in population density
and this project will not p.roduce an undue burden oh available
governmental fa~ili.~es; ' (c) the grant of this vabiance~will
not produce a .substantial chang~ in the.charac%er of the
neighborhood or create'a substa.ntial detriment~ to adjoining
properties since similar setbacks ha~elbeen established in the
neighborhood; ~ (d) the difficulty cannot be obviated by a
method feasible for appellant to.pursue other than ~ variance;
(e) the circumstances of the property are uniq e' ~
