1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
,
sary HARDSHIP because other property sold previous to 1957 have been
deeded beach rights and access to the beach through part of
the adjacent properties, therefore I could not. give full use
of the property to the purchaser. All lots sold on south side
of South Lane are similar to the proposed lot I wish to sell now.
2. The hardship created is UNIQUE and is not shored by all prapel1ies alike in the immediate
vicinity of this property and in this use district because it is unique in that it is odd
sh~ped lot that contains ..xe than the required frontage.

3. The Variance would observe the spirit of the Ordinonce and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because all other lots on south s ide of South
Lane are similar size and shape as the proposed lot next to it.
This is a residential district mostly summer homes and proposed
use is residential similar to all others.

tormerly Thorp; S -"beach area"; W - path or R.O.W; Please be advised
that the Board ot Appeals granted a variance on November 21, :.963
(appeal 1617) settinl~ off this lot as a single and seperate lot 10Iith
no special conditions or timp limit.
The description given in your letter does not exactly match
the map submitted to the Board, but is basicaly the same lot and would
be usable for anyone family dwelling that meets the requirements ot
the zoning ordinance.

Gentlemen:
I represent Mr. and Mrs. Thomas L. Minnigan who are about to
purchase the following described property located at East
Marion from Mr. Frank S. Thorp:
"BEGINNING at a point on the southeasterly line of South Lane
which when measured along said line is distant 77.75 feet
northeasterly of the northeasterly line of land conveyed by the
parties of the first part to Flora E. Gernannt ( and which
point is at the northeasterly corner of the right of way leading
to the beach which is hereinafter described) and running thence
south 31 degrees l' 30" east along said right of way 179.37 feet
to the "beach" hereinafter described; thence north 39 degrees
21' 20" east along the 'beach" 69.56 feet to other land of the
parties of the first part; thence north 31 degrees l' 30" west
along said other land of the parties of the first part to the
southeasterly line of South Lane; and thence south 42 degrees
46' 30" west along South Lane 67.34 feet to the point of BlilGINNING."
Mr. and Mrs. Thorp have advised me through their attorney that
an application was made for a variance to build a dwelling on
this plot which was required because the frontage was less than
100 feet.
Will you please confirm in writing whether such variance was
granted, whether it is ~ill in effect and whether there is any
expiration date for the variance; in other words, does construc-
tion have to begin within a certain period of time.
