confirmed because : After investigation and inspectica the Board finds that
a 5 ft. projection for a porch, steps or bay window would be permitted
in this location and the applicant is only requesting a 4 ft. extension
from the existing setback line. This is the applicant's fourth appli-
cation in a year to the Board to solve his problem of additional area for
eating space and the Board feels this is the best solution under the
circumstances. The proposed 4 ft. projection from the hOuse constitutes
a passageway to the addition in the rear and it is the Board's opinion
this passageway is a necessity and it should, be permitted.

The Board finds that the public convenience and welfare and
justice will be served and the legally established or permitted use
of neighborhood property and adjoining use districts will not be
permanently or substantially injured and the spirit of the Ordinance
will be observed.
Therefore it was RESOLVED that Raymond J. Slavin be granted
permission to reduce his front yard setback on a corner lot to
22 ft. 6 in. on Oak Drive, Cutchogue, New York.
It is a condition of this special exception that the balance
of the structure constructed in violation of the Zoning Ordinance
last year be removed from the slab bySeptember 1, 1963.

I em the owner of ~roperty on the S/E corner of Broadwaters and Oak Drive,Broadwaters
§ove, area f~vmerly known as the Mason Development. I purchased the property in
~1~? 195& and ha4 the existing dwelling Sv~O*b~gin April 1956. Zoning became
effective a year later. This dwelling was set up with the kitchen area facing on Oak
Drive. The house when constructed was sm-ll 2~' x 28'. I planned th~s home for my
retirement. I now find that ~ need a dining area and logically the only place to
erect such an area is off my kitchen.
The Board of Appeals has previously granted under separate appeal a rai~ed patio
standing about 2 ft high and extending from the house 11Ft??" out in the directionof
Oak Drive, placing this patio about 15' from the town line. As it exists it is of
little use to me as it cannot be covered. If the Board would permit a & Ft passageway
as outlined in the Application f~,Buildtng Permit I can then erect a porch to the rear
and be sheltered fro m the kitchen to the pm~ch area. The Board has previously advise~
that since what I term as the rear of my property has become under zoning, the side
I can erect a po~ch up to 5 Ft of my property line. This proposed strumture with
the passageway would only require going up to 8ft6" of the property line. To construct
the porch at the rear without the passageway would require removal of my utility room
containg the cold and hot water tanks and the ~a%er pump, all of which existed priO~
to zoning.
! again refer the Board to a petition signed by over 75~ ~f the residents of
Broadwaters Cove and particularly to t he fact that the three property owners to myeast
who comprise the entire block signed this petition stating that a covered porch
extending ~o w~thin 15 ft of the town line ~as unojectionab~ , that most certainly
there would be no objection to a structure over 22ft from the Town line.
