STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unnecessary HARDSHIP because the foundation for the dwelling to be moved is already in place. All parts of the foundation are at least 35 feet back from Conklin Road. However the South line of the foundation varies from 22 feet to 34 feet from the North line of Middle Road Extension. This is shown on the surveyor's map annexed hereto as Schedule A and made a part hereof. From a practical point of view the South line of the house is much more than 35 feet from Middle Road Extension itself as it is physically built on the ground. For a reason I do not know the county in acquiring land for Middle Road Extension took a strip generally of uniforE width of about 100 feet. However in the particular spot which adjoins my lot they took an additional 60 to 80 feet of width on my side of Middle Road. From a practical standpoint, therefore, the South line of my lot is about 60 to 70 feet from the road instead of being immediately adjacent to it if you consider the physical road rather than the taking line. Probably some of this land was taken for site distance because there is an intersection and perhaps the rest was taken because had they not taken all the land of the property owner at that point that which they left to him would be more or less useless under the present zoning in that area. Inadvertently, unintentionally and through error and mistake the contractors whom I employed to erect the foundation installed the foundation in place as shown on the annexed map. As a result the South line of the house foundation is 22 to 34 feet from the road line instead of 35 feet as required by the ordinance. If you think in te~ms of the road as it actually exists on the ground my South line is really from 82 to 94 feet or mare from the North line of the road as it is being constructed. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because this is the only house in this section in which this mistake was made° 3. The Mariance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because this plot would still be a residential plot and the dwelling will actually be several times 35 feet back from the road as it is physically constructed. In violation it is really technical resulting from the taking by the county of considerable additional land adjoining the road proper in this spot. We understand that no has yet been made but it has been inferred that this would not only be used for site distance but for the materials such as sand and gravel or highway maintenance. If that be so and we believe that it will be, then the land that we are too close to will not be being used for a road at all but will be being devoted to storage and other purposes apart from the road like any other piece of land used for storage or building. In that sense then the South line of our lot would really adjoin land used for storage purposes rather than a highway and would to all intents and purposes be a side line rather than a front yard. Tuthill. This plot of land extends from Conktin Road to Mary's Lane. The house formerly owned by the Tuthills and located at what will eventually be the northeast corner of Conklin Road and Middle Road was purchased from the County by l~r. John Sidor who purchased a parcel of land immediately to the north of the former Tuthill property so that he might re- locate the Tuthill house on the same. We have been advised that in constructing the found- ation upon which to relocate the house, it was inadvertently placed about 18 feet from the County taking line which does not conform to the zoning requirements of the Town of Southold. Due to the physical characteristics of the property acquired and the fact that the proposed new location of the house will be 80 feet or more from the curb line of the new highway, its new location will in no way affect the sight distance at the intersection nor will it in any way affect the County's use of the property. The future use the County may make of the laud acquired precludes the sale of any portion of it to 1~, ~idor. we recommend that the Zoning Board of Appeals grant a variance to lvm.
