BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated February 20, 2002,
denying a permit to (a) construct and locate a new building (No.1) with more than 60 linear feet
of frontage on one street, (b) construct and locate a new building (No.2) with more than 60
linear feet of frontage on one street, ref. Section 100-133C, and (c) to construct and locate off
street parking at less than the required 50 foot minimum to the street and lot lines pursuant to
Section 100-131C (9).
AREA VARIANCE REQUESTED:. Applicant is requesting the board to reverse the building
inspector's determination that a variance is required for the proposed 115-foot width of building
No. 1 because under prior Appeal No. 4547, dated June 23, 1998, the board granted a vadanca
to construct a 115-foot wide building in almost the identical location. Applicant is requesting the
board to reverse the building inspector's determination that a variance is required for the
proposed 91-foot width of building No. 2 because the building does not have frontage on a
street, and is located behind building No. I more than 300 feet from the Main Road. Applicant is
also requesting the board the lift the condition imposed under pdor Appeal No 4527, dated June
23, 1998 with respect to off street parking and loading, or the reverse the building inspector's
determination.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 16, 2002 at which
time wdtten and oral evidence were presented. Based upon all testimony, documentation,
personal inspection of the property, and other evidence, the Zoning Board finds the following
facts to be true and relevant:
1. (PROPERTY FACTS) The subject property consists of a total of 5.9 acres and is located on
the south side of Main Road in Greenport. The property is zoned LIO (Light Industrial Office)
and is located in a neighborhood that is commercially developed. The site plan, prepared by
Donald Alan Denis, Architect, dated August 21, 2001, last amended December 18, 2001, shows
plans to demolish the existing building and construct a 14,100 sq. ft. retail/office warehouse with
a width of 115 feet facing the Main Road. This building, No. I would be set back 110 feet from
the Main Road, with customer parking in front of the building and a 25-foot buffer zone between
the parking area and the Main Road. Building No. 2 is proposed for the drive-through operation
of the lumber yard. It is 23,660 sq. ft. with a proposed width of 91 feet. Building No. 2 is located
70 feet behind building No 1 and more than 300 feet from the Main Road. The site plan also
shows a 5,000 sq. ft. warehouse building.

2. In reviewing the revised plan, the board finds that it is not substantially different than the plan
which was reviewed by the board and granted variances under Appeal No. 4547. Instead of one
large building of 53,425 sq. ft., the applicant has reduced the size of the principal building to
14,100 sq. ft., and created a separate 23,660 sq. ft. building in the rear of the principal building
for the drive-through operation of the business, and a 5,000 sq. ft. warehouse building.
3. The 115-foot proposed width of building No.1 is identical to the width variance granted by the
board under Appeal No. 4547. The board notes that the pdor variance was granted on condition
that the applicant maintain a minimum 110 foot set back from Main Road in order to provide
additional landscape buffer, which the applicant's have complied with. Since neither the 115 foot
width of the building nor the minimum 110 foot conditioned set back to the Main Road have
changed, no further variance is required for building No. 1.
4. With respect to building No.2, the building inspector states that the proposed construction is
not permitted pursuant to Article Xlll, Section 100-133C on the grounds that the building has
"linear frontage of 91 feet." The code prevision specifically states that, "a project shall be
divided into separate structures so that no sin,qle structure shall more than sixty (60) linear feet
of fronta,qe on one (1) street." The building (No. 2) in question does not have frontage on one
street. It is to be located 70 feet behind building No. 1 and more than 300 feet from the Main
Road. The board believes a clear reading of the provision indicates that it was intended to
prevent the strip mall effect of one or many excessively wide structures facing the street. In this
instance, the code provision is not applicable because the building does not have linear frontage
on a street.
5. With respect to off-street parking and loading requirements pursuant to Article Xlil, Section
100-131, C (9). The board notes that the location of the parking and loading areas were worked
out with the Planning Board dudng its site plan review of the project after the Board of Appeals
granted its approval under Appeal No. 4547, which included a condition #3, that off-street
parking areas comply with 100-131. In reviewing the amended site plan, the board finds that
compliance with this condition is neither practical, nor would it in any way improve the layout or
design of the plan, or serve any useful purpose.
BOARD RESOLIITION: For the reasons stated above and, on the basis of testimony
presented, materials submitted, the board makes the following determinations:
Now, on motion by Member Tortora, seconded by Chairman Goehringer, it was
RESOLVED, to REVERSE the Building Inspector's February 20, 2002 determination that
Building No. 1 requires a variance pursuant to Article XIII, Section 100-133C because
such variance was granted under prior Appeal No 4527, dated June 23, 1998.
BE IT FURTHER RESOLVED to REVERSE the Building Inspector's February 20, 2002
determination that Building No 2 requires a vadance pursuant to Article XIII, Section
100-133C because such building does not have frontage on a street and the provision is
not applicable to this structure.

BE IT FURTHER RESOLVED to LIFT ZBA CONDITION No. 3, imposed under prior
Appeal No. 4527, dated June 23, 1998 with respect to off-street parking and loading
requirements pursuant to Article XIII, Section 100-131C (9), because such condition is contrary
to, and in conflict with, the overall revised site plan elements, which have been reviewed by the
Planning Board, who have recommended approval of this project.

At your request, I visited the above referenced site on May 22, 2003, to examine
the construction of the National Store Fixtures building erected at the location. The
structure spans 111 feet and is 260 feet long to cover the building materials storage area.
My visual examination revealed the structure to have been constructed according to plans
and specifications and in accordance with the manufacturers requirements.

In an attempt to ease the concerns ufour Greenport neighbors in respect to the site
lighting at our new Greenport complex, we intend to make the tbllowing adjustments.
1.)
We will adjust downward the two 400 W high pressure sodium flood fixtures
on the southwest corner of building #3 and thc two like fixtures on the south
wall of Bnilding #2. The 250 W down light on the southeast corner of
building #3 should bc no problem.
2.)
All exterior fixtures on Building #2 and #3 will be put on timer switches so
that they can be set to go offal a reasonable evening hour, and off completely
on weekends. Our intent for these lights is for use during working hours to
prox idea safe working environmenl.
3.)
The pole mounted 400 W riood lights, which are yet to be installed, will be
operated hy photo cell and rcmain oo lbr security lighting. All of these lights
will be directed inward toward the site.
We feel these measures should ease all reasonable concerns. These adjustments
have already been ilnplemented, however, some of the items will require rewiring and
nlay take a week or twn to complete.

PHASING AND LOT COVERAGE

Dear Mr. Verity:
The Riverhead Building Supply Corp. is renovating and expanding their facility in
Greenport for which they have received Site Plan approval. The Site Plan indicates that
three new buildings will be constructed. There are currently two existing buildings on the
site. In an attempt to keep the business operational, the project will be "phased". The
first phase will involve the construction of the two rear buildings, Building 2 and
Building 3, as well as the demolition of the rear storage rack portion of the existing main
building (approximately 2620 s.f.). At the end of Phase I the lot coverage will be 16.2%.
The second phase would involve the demotion of the two existing buildings, as well as
the construction of the front building, Building 1. Atthe end of Phase II the lot coverage
would be 16.7% . As a further note, demolition permits will be obtained for the
demolition of all buildings. If you have any other questions on this matter, please call our
office.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit,
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months afier the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or

GENERAL NOTES & REQUIREMENTS
GENERAL '
A. This pta act has been designed according to the criteria shawn an
{his page,
B. The following notes apply to this project and all corresponding
drawings and ~hall govern in the case of any discrepancy.
C. it is the Installer's duty to ensure that all procedures and
~quipment used in the project installation are in compliance to
local safety codes, and regulations, and to the drawings and
specifications provided herein. Any situations or conditions not in
compliance to the foregoing terms are not permitted without the
written consent of the Cognizant N.S.F. Engineer and the involved
local Building Officials.
O. The Customer is required to keep all testing and investigation
reports, and permits accrued throughout the development of the
project available at the job site.
E. N.S.F. is not responsible for items, connections, and additions, which
will be supported by the structure, not initially included in the
N.S.F. project specifications, The Customer will be responsible for
the necessary design and attachment of such additional items.
F: N.S.F. will not be responsible for damage or failure of the building
and/or its components due to: improper installation, use of
faulty equipment, temporary bracing failure, inadequate concrete
design,, improper/unadvised use, or any additional items or
connections not outlined in the project's specifications.
G. AIl dimensions and existing conditions & dimensions shall be verified
by the Installer.
H. The nstaller will be responsible for proper interpretation of the
geographical orientation of the project on site. it is not N.S.F.'s
intention to,represent the project on the drawings according to
(]ny certain (~Bentation concerning North, South, East, or West.
h The fallowing drawings have been designed according to the project
specifications and N.S.F. standards. Project erection must be in
compliance to the foliowlng drawings. No use of, disclosure
of, or reproduction of this set of drawings or the information
herein shall be made without the prior written consent of N.S.F.
J. Acceptance of possession of these drawings and the information
herein shall constitute your agreement to the foregoing terms and
condiUons.
CONCRETE
A. All concrete shall be in compliance with local codes.
B. All reinforced concrete slabs and footings must be designed by a
registered professional engineer for the state of the project's
location. The concrete design will be based on local codes and
the designed project's loads and base reactions by N.S.F. (made
available upon request), N.S.F, requires a minimum thickness of
6" and minimum d]stance of 6" from the anchor to edge of the
concrete slab for proper anchoring, however, the design is the
responsibility of the customer and his or her qualified engineer.
C, Floors and slabs on grade level must maintain a surface flatness of
maximum 1/~ inch in 10 feet. N,S.F. is not responsible for
concrete design or flatness.
BUILDING LAYOUT
A. Roof supporfing and intermediate columns will normally vary in size.
Location of these cotumns will always be in reference to the
centerline unless specifically noted otherwise in the following
drawings.
B. The installer is responsible for consulting with Customer to
determine the exact locations of cantilever arms. The same
inquisition must be made concerning the location of pallet rack
shelves (beam locations). These locations shall be closely related
to these shown on the following drawing(s) (minor deviations are
allowable),
C. Pallet rack upright widths are from outside face of post to outside
face of post. ' All dimensions along width of building will be
referenced to these same points, Dimensions along length of
building will be referenced to centerline of uprights. Pallet rack
beam lengths refer to inside-to-inside face of uprights (bay
opening).
D. The above guidelines will only differ according to specific notation or
detail representation on the following drawing(s). Any major
deviations from the following drawing(s) or the notes above may
result in failure of the structure or its components (see note h in
the "GENERAL" section above), in the case of a major deviation,
the Installer is required to contact the Cognizant N.S.F. Engineer
prior to procedure.
CONNECTIONS
A. Bolts that are utilized throughout the proJect ore Grade 5 and
Grade B. Primary framing connections will utilize 3/4"¢ and
Grade Ii or Grade 5 bolts and secondary framing connections will
utilize 1/2"¢ Grade 5 botts. The Froper bolt length and
descripUon is shown for each condition on the following drawings.
B. All 5/4"¢ bating on cantilever for bases, bracing, roof-turbs,
and arms shall be torqued to 250 fl-lbs, minimum. Refer to
A,hS,C. for torquing info.
C. All girder connections must be installed using hardened washers
on nut side and torqued using turn-of-the nut method in
accordance with A.hS.C. specifications.
D. The Installer shall use washers at all slotted hole locations unless
noted otherwise.
gRACING
A. The installer is responsible for ensuring the safety and effectivity
of all temporary bracing. N.S.F. is not responsible.
B. Cable bracing will only be required as shown on the following
drawings. The Installer may be required to assemble the
components of the cable bracing prior lo installation.
C. Flange brace struts at girders are to be located on one side of
the girder unless noted otherwise on the following drawing(s).
The Installer is g~ven the freedom to dec,de on whiich side of the
girder to put the struts, however, all struts on a pertain girder
must be on the same side.
D. Jn the event that sidewall cladding will be located between columns,
the cantilever bracing must be oriented according to the following
procedure. The horizontal (HER__) and vertical (VBR__) bracing
both consist of 2"x2" horizontal angles (each having a verLieaJ
and horizontal leg). These angles must be positioned in such a
way that the vertical leg is closer to the aisle-side or inside of
the buTIding than to the side on which the cladding wiU be. This
is to ensure an uninterrupted vertical plane for the cladding.
Special girt angles will be instdJed in opposite orientation (utilizing
the same bolts and nuts in the regular bracing attachments) for
the cladding. This same procedure is to be used at columns
along which downspouts will be located (see note D. in the
"CLADDING/TRiM" sectTon).
ANCHORS / FASTENERS
A. N.S.F. will supply anchors for the project unless otherwise arranged
with the Customer.
g. When anchors are supplied by the Customer they. must be equivalent
,to those specified in the following drawings.
C. The Installer is" required to place anchor bolts according to the
illustrations and notes shown in the followlng drawings. Any
conditions or situations that deviate from the drawings must be
approved of by the N.S.F. Cognizant Engineer.
D. To ,instal[ anchors, drive the wedge anchor far enough into the
h'de so at least 6 threads are below the top surface of the
fixture, usTng a 2-lb. hammer. Tighten nut to thio recommended
torque value wlth a torque wrench. If a torque ~wrench is not
available, tighten 2 to 3 turns from the finger tJglht position.
Please refer to the Anchoring Specification Table tto determine the
Draper torque for anchors.
E, In the case of special fasteners, materials or comdiDons for which
special tools or equipment are required, N.S.F. willl make them
available to the Installer (as property of N.S,F.). , These conditions
will always be noted on the drawings, and the necessity of such
equipment will be determined by N.S.F. The Inst¢ller will be held
responsible for the equipment and will accept llabiHty concerning
it. This equipment or tod(s) must be returned bo the N.S.F.
salesperson upon compleUon of its use.
CLADDING / TRIM
A. All cladding, trim, and related accessories include'd in the project
specifications may be shipped to the job site separately from the
project. It is the Installer's duty to correctly correlate between
parfs/quanUties required and ports/quantities supplied. The
Installer is required to inspect the materials prior to accepting the
shipment and is dso responsible for proper stardge and handling
of such materials. In the event that materials are already
on-site at the time of the Installer's arnvd, the Installer must
check the materials to ensure proper shipment of parts and
quantities. The Installer must keep track of all materials
throughout the project installation process.
B. The Installer is advised to give attention to trim conditions
before erection of cladding, Many situations require trim to share
fastener(s) with cladding panel(s).
C, Cladding may be installed from left to right or from ricjht to left,
however, it musi: be laid out as shown or noted on the drawings.
The panels may nat be overlapped in any way ether than the
normal sidelap of the last rib (at edge of panel,s) and also at
endlaps. Panels extending past a desired area rmust be field cut
(not back-lapped),
D. Downspouts wlll be routed down along the side iai a cclumn being
set back as far as passible against the bracing between columns
(see note D. in the "BRACING" section). Bownspoluts shall be
located no more than 40' on center.
E. Skylites provided must be installed 'as-is.' The)y may ,qot be cut
or modified in any way.
