2. VARIANCE. By resolution of the Board it was determined that

After investigation and inspection the Board finds that the
applicant has a parcel of land with two dwellings thereon. The
premises were purchased in two separate transactions in 1959 and
is divided by monument lines. The applicant now wishes to sell
the house and property in the rear but wishes to divide the property
along a line of trees. The Board is of the opinion this would
leave an insufficient frontage of 29 feet and therefore they
will only permit the division if it is made as follows: Beginning
at a monument 55. 40 feet northerly from the southwesterly property
line and running southeasterly from the point of beginning on a
diagonal to the first tree on the proposed line identified by Otto
W. Van Tuyl on a sketch of proposed division, thence northeasterly
and thence northerly along the proposed division and continuing
northerly to tle northerly boundary line of the front lot.
The Board finds that strict application of the Ordinance will
produce practical difficulties or unnecessary hardship; the hard-
ship created is unique and would not be shared by all properties
alike in the immediate vicinity of this property and in the same
use district; and the variance will observe the spirit of the
Ordinance and will not change the character of the district.
Therefore it was RESOLVED that William E. Morgan and Matilda
E. Morgan be granted a variance (this application was amended to a
variance from a special exception) to divide their property located
on the east side Private Road, south of Indian Neck Road, Peconic,
New York, lot 34 on map of"Indian Neck Park" into two parcels as
heretofore described.

hereby apply to THE ZONING BOARD OF APPEALS for a SPECIAL, EXCEPTION in accordance with the
ZONING ORDINANCE ARTICLE 3 SECTION 303 , Article X1000 A
SUESECTION
THE SPECIAL EXCEPTION IS REQUESTED BECAUSE We are the owners of Lot No. 34
on "Map of Indian Neck Park", filed in the Suffolk Co. Clerk's Office
as Map No. 551, and wish to subdivide the property with resulting areas
of less than 12,500 square feet and a frontage of less than 100 feet.
The premises were purchased in two separate transactions, the dividing
line being shown by the monument lines. The northerly section contains
12000 square feet and the southerly section 8,900 square feet.
We have now contracted to sell the portion south and east of the line
entitled "Proposed Division Line", contingent upon the necessary
variance .from your Board. The resulting area would be 11,700 square
feet for the front lot and 9,500 square feet for the back lot. The
frontage would also be reduced from 55 feet to 29 feet. The frontage,
however, is immaterial to the lot being sold since this is used
merely for access and the new boundary has a much more natural line
with the line of trees. It also gives sufficient space on the
southerly side of the front house which is lacking In the monument
boundary line.
Advantage also can be had of the right of way south of the premises
on which there is a road frontage of 28.28 feet.
The proposal not only narrows the difference between the areas of the
two lots but also gives the rear house a much better yard advantage.
