1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HA~DSHIP m.. ...- Attached hereto is a sketch showing location of the
property and the right of way designated .Private Road. running south from
Park Av,enue. Applicants havecontraeted to sell parce:). 1I1arked .e. subject
to a necessary var.ianee fot' access ove!' a .29foet'right of'way.. There is
no other acoess to the property. Applicants had first considered dividing
this plot into two sIl!8.1l~I' plots "0" and "D" but have been a:t>le to
negotiate a transactfoh for all of the parcel and thus ask for only one
access rather than two if the parcels were so sub-divided.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district ~"'I[
. .
Applicants residence is situated close to peconic Bay leaving a
vast portion of the property as excess property unless disposed of. In
blocking it off in three lots, two of which are on Park Avenue, applicants
are able to have use of the private road minimized to two families.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because there are two houses on applicants'
property, the residence mentioned above and a smaller cottage on Lot B.
This is the last residential property on Park Avenue since it adjoins
the air strip of Mattituck Airbase. In this situation, it would seem
that additional residences would not affect the character of the
district.
