1. SPECIAL: EXCEPTION. By resolution of the Board it was determined that a special_exception ( X) be

confirmed because:After investigation and inspection the Board finds that
this is a temporary accessory building for non-commercial
purposes and is restricted to the personal use of the appli-
cant Mr. W. Harry Lister.
This structure which was erected is a necessary incidental
use in the "M', Multiple Residence Zone, however the restriction
applying to Mr. Lister is for the protection of neighbors in
the future in the event Mr. Lister should sell or lease the
premises described in the application. (OVER)
2. VARIANCE. By resolution of the Board it was determined that

The location chosen is the only obvious and useful one
for the applicant since it is at the dock area where his boat
is moored and the building is used for the storage of his
boating equipment.
The Board finds that the public convenience and welfare
and justice will be served and the legally established or
permitted use of neighborhood property and adjoining use
districts will not be permanently or substantially injured
and the spirit of the Ordinance will be observed.
Therefore it was RESOLVED that W. Harry Lister be granted
permission to erect and maintain a temporary utility or accessory
building on his multiple residence premises located on the south
side of West Road,- Cutchogue, New York, approximately 12 ft. 6 in.
from West Road and approximately 12 ft. from the bulkhead or
rear line.
This building is restricted to the personal use of the
applicant W. Harry Lister.
8: 15 P.M. (E.D. S.T. ) , upon application of W. Harry Lister,

accordance with the Zoning Ordinance, Article IIIA, Section

hereby apply to THE ZONING BOARD OF APPEALS for a SPECIAL, EXCEPTION in accordance with the
ZONING ORDINANCE ARTICLE III A & VII SECTION 354 and 358, and 703
respectively.
THE SPECIAL EXCEPTION IS REQUESTED BECAUSE The structure attached to the
bulkhead area is a temporary accessory building and not permanently
affixed to the realty. That said structure is of the following
dimensions:
Front 714" ; the Width 712" ; Height 7' to 81 , and can be moved from
its present site by removing four bolts which affix it to the realty.
That upon the advice of the contractor erecting the structure no
building permit was applied for pursuant to Article VII, Section 703.
That the completed dock and bulkhead was built in 1957, in
which year, a Special Exception was granted by this Board to use the
premises as a non-commercial marina. That said structure was there-
after erected as an accessory use and incidental thereto.
The front of said structure is about 12' 6" from the South side
of West Road and the rear of the structure is about 12' from the
bulkhead. While the front and rear yards do not meet the require-
ments of Article III A. Sections 354 and 358, a strict application
of these sections would produce practical difficulties and unnecessary
hardship since it would necessitate removal of the structure to anoth-
er area of the marina where its use as an accessory building could not
be utilized. It is respectfully pointed out, however, that if the
structure were turned about so that a side of the building was facing
the southerly line of West Road, there would be no violation of any
of the above sections of the zoning Ordinance. Thus, to compel a
strict application of the Ordinance in this case would be to defeat
the spirit of the Ordinance.
