State hereby apply to THE ZONING BOARD OF APPEALS for a SPECIAL EXCEPTION in accordance with the ZONING ORDINANCE ARTICLE III SECTION 306 ~ This application is made in conjunction with a similar application by Raymond Rignel and Muriel Rignel, owners of the property immediately to the west. In Appeal No. 520 before this Board by August W. Rucks and Matilda RuCks, the then owners, for permission to divide the property it was stated that it was the intention of the purchasers to erect homes on each lot facing East Road. Mr. and Mrs. Rignel and the ap- plicants propose to erect similar homes approximately 60' x 26' each facing East Road, and being on a line east and west with a set back substantially more than 35 feet. It would not be possible to erect these homes, however, with a 35 foot set back on the side streets, namely: Fleetwood Road and Betts Street. Requests are therefore made for 25 foot set backs on each of these roads. Immediately to the north of applicants' parcel there is a rectangular bungalow type house with a set back of less than 20 feet and with the porch of about 4 feet. To the north there are additional houses with a greater set back. These houses, however, are on lots extending from Fleetwood Road to Betts Street and are barely visible, if at all, for the location where they intend to build their house. This is due to the fact that the house to the north as above described, is on the crest of a hill. Thus, the house and the contour of the land act as a visible barrier. Directly across Fleetwood Road from their proposed location, is a garage right on the boundary lin and south of their property and south of East Road, there is a residence, the set back of which is about 15 feet. Their house is to have a garage underneath and facing Fleetwood Road. This is to be a substantial aIr year round house. It will be an asset to the community and they believe that there will be no detri- ment to the adjoining properties with a 25 foot set back to Fleetwood Road which is a two rod road.
