Box 852 Bohemia, NY 11716 RE: ANGELIKI KAZEROS & GEORGE PLITAS 1395 SLEEPY HOLLOW LANE, SOUTHOLD SCTNI# 1000-78-1-10.20 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, December 14, 2022 regarding the above matter: WHEREAS, Jeffrey Patanjo, on behalf of ANGELIKI KAZEROS & GEORGE PLITAS applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, application dated October 12, 2022; and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS;the LWRP Coordinator recommended that the proposed applications be found Inconsistent with the LWRP, and specifically Inconsistent with the following coastal policies: Policy 6 & 9 and with the LWRP: 1. The growth habit of spartina patens and spartina alterniflora cause die-off each year and regeneration each spring. The installation of pilings in a salt marsh results in the permanent destruction of both these species where pilings are placed. Unless a path through the salt marsh is trampled frequently, the harm of a footpath is less than that of a permanent, wooden structure. 2. The intrusion of pesticide treated lumber in a living ecosystem is not supported by Policy 6. The water in the area is very shallow. 3. Access for kayaks and other water-dependent recreational activities can be obtained at the numerous launch and access points throughout the Town designed for that purpose. WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 14, 2022, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, on August 20, 2008 a previous application to construct a 4'x55' catwalk was Disapproved by the Board of Trustees; and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-12. Standards for Issuance of Permit. A. Adversely affect the wetlands of the Town; D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof, I. Otherwise adversely affect the health, safety and general welfare of the people of the Town; J. Adversely affect the aesthetic value of the wetland and adjacent areas; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, adversely affects the tidal waters of the Town. BE IT FURTHER RESOLVED that the Board of Trustees DENIES based on no action the application of ANGELIKI KAZEROS & GEORGE PLITAS to construct a 4' wide by 134' long catwalk consisting of 6" diameter piles, steps to ground on landward side, steps to mean low water on seaward side, and using Thru-F1'ow decking; and as depicted on the.site plan prepared by Jeffrey Patanjo, last dated October 4, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with LWRP Policy 6 and 9 and with the LWRP. 1. The growth habit of spartina patens and spartina alterniflora cause die-off each year and regeneration each spring. The installation of pilings in a salt marsh results in the permanent destruction of both these species where pilings are placed. Unless a path through the salt marsh is trampled frequently, the harm of a footpath is less than that of a permanent, wooden structure. 2. The instruction of pesticide-treated lumber in a living ecosystem is not supported by Policy 6. The water in the area is very shallow. 3. Access for kayaks and other water-dependent recreational activities can be obtained at the numerous launch and access points throughout the Town designed for that purpose.
