Notice of Hearing
Pursuant to Section 267 of the Town Law and theprovisions
of the Amended Building Zone Ordinance of the Town of Southold,
Suffolk County, New York, public hearings will be held by the
Zoning Board of Appeals of the Town of Southold, at the Town
Office, Main Road, southold, New York, on April 11, 1963, on
the following appeals:

Sound Avenue, Mattituck, New York, for a variance in accord-

REASON FOR APPEAL
I ) A Variance to Section 280A Subsection 3
!it) A Variance to the Zoning Ordinance
(It) Reduction in frontage
is requested for the reaSOn that the lot on which it is proposed to convert the
accessory building into a residence has a frontage of 71.50 on Sound A~nue
which is less than the 100 foot frontage required by the ordinance. There
is a right of way 18 foot in width immediately to the West of the premises,
which right of way is an appurtance of the premises making the lot for all
practical purposes 89.50 in width. The lot i8 229.70 feet deep on the West
and 213.54 teet deep on the East. The lot therefore has more than the
reauired minimum square footage in area.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce procticol difficulties or unneces-
sory HARDSHIP because there is an 18 foot right of way on the West and
a side yard of 30 fMet on the West also, there i. a 20 toot side yard
on the East coupled with a 60 toot side yard immediately adjacent on
other premises of the applicant. The premises owned by the applies nt
have a combined frontage of 182.05 teet plus an 18 toot raodway or
right of way totaling more than 200 feet. The roadway is not owned but
is adjacent to the premises. The lot in question was owned in single
ownership prior to zoning.
2. The hardship created is UNIQUE and is nat shared by all properties alike in the immeqiate
vicinity of this property and in this use district because applicant made application
to the Building Inspector in September 1962 for permission to
move a garage on the property. Thereatter he waa required to su~it
several copies of a survey showing the dwelling houses and also
indicated the proposed location of the garage. Thereafter the aw lica tiQD
was approved by the Commissioner ot Public Works with respect to the
dwelling on Middle Road. Atter applicant moved the garage on the
premises in accordance with the survey submitted to the Building
Inspector he was inforJled that such would be in violation. Applicant
wishes to convert said garage into a dwelling and does not wish to be
in violation of the ordinance.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the proposed dwelling will be set back
further than other existing dwellings and will be located on a lot
wi th more area than most of the other lota on Sound Avenue in the
near vicinity. The front, side and rear yards will be more than
that required b under the ordinance.
